APPROVE and AUTHORIZE the Real Estate Division to begin right of way acquisition activities and perform
related right of way services for the I-80/San Pablo Dam Road Interchange Project;
ADOPT, as responsible agency, the Mitigated Negative Declaration for the Interchange Project;
DIRECT the Director of the Department of Conservation and Development to file a Notice of Determination; and
AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to the Department of Conservation and
Development for processing, and a $50 fee to the County Clerk for filing the Notice of Determination. (Project No.

FISCAL IMPACT: (CONT'D)
Authority (CCTA) will pay the actual costs for Public Works Real Estate Division’s right-of-way services.
BACKGROUND:
CCTA is planning the I-80/San Pablo Dam Rd. Interchange Project, to be constructed before fiscal year 2015.
CCTA requires a variety of right-of-way services for the project but has no right-of-way staff. On December 4,
2012 the Board of Supervisors approved an agreement with CCTA to perform right of way services necessary for
the Interchange Project. The Real Estate Division will perform various right-of-way services for CCTA, including
but not limited to appraisal, negotiations, relocation, right of way acquisitions, and supervision of independent
contractors. The property interests acquired by the County will eventually be transferred to the State or the City of
San Pablo.
The California Department of Transportation (CALTRANS) is the lead agency for the Interchange Project.
CALTRANS previously adopted, as lead agency, the Mitigated Negative Declaration for the project. As
responsible agency for the project, the County also is required to adopt the Mitigated Negative Declaration for the
project.
CONSEQUENCE OF NEGATIVE ACTION:
Real Estate Division would not be able to move forward with the real property transactions necessary for the
project.
