ACKNOWLEDGE that on May 14, 2013, the Board of Supervisors, acting in its capacity as the Governing Board of the County of Contra Costa and all districts of which it is the ex-officio governing Board approved the FY 2013-14 Recommended Budget requiring the modification, addition and elimination of certain positions in certain County Departments and the Contra Costa Fire Protection District; 2. ACKNOWLEDGE increased allocation of Measure H funding to the Contra Costa County Fire Protection District in the amount of $477,550 over and above the 2013/14 Recommended Budget estimate due to the change in funding allocation methodology approved by the Board of Supervisors on May 14, 2013; 3. ACKNOWLEDGE that the Contra Costa Fire Protection District inadvertently received $1,266,279 in Pittsburg Redevelopment Pass-through funds, the repayment terms of which are currently being negotiated; 4. ACKNOWLEDGE that, due to increases in pension costs, employee costs will be significantly higher in FY 2014-15 than in FY 2013-14; 5. 6. FISCAL IMPACT: The fiscal impact of this action is described in the Fiscal Year 2013-14 Recommended Budget beginning on page B-321, which is available on-line at http://ca-contracostacounty.civicplus.com/index.aspx?NID=770. Detailed impact is included in the Background section of this report. BACKGROUND: On April 24, 2012, the Board held Budget Hearings required prior to adopting the FY 2012-13 Recommended Budget. At the conclusion of the hearings, the Board directed the County Administrator to return with a Resolution ordering the adjustment, addition and deletion of positions necessary to balance the FY 2012-13 budget and the deletion of positions that are vacant and unfunded. The adopted 2013-14 Recommended Budget, for the Contra Costa Fire Protection District includes the closure of two fire stations, resulting in a projected savings of $3.05 million and a reduction of 18 full-time equivalent (FTE) positions. Additional positions will continue to be held vacant in order to achieve prescribed cost savings through normal and managed attrition to the greatest extent possible. Under the recommendation, one station would be closed effective July 1, 2013 (this date has been adjusted to July 5, 2013) and a second station would be closed effective January 1, 2014. This 22 station model is estimated to result in the District ending fiscal year 2013-14 with a positive fund balance in both the Operating Fund and the POB Stabilization Fund in the amounts of $2.5 million and 3.9 million, respectively. On May 14, 2013, the Contra Costa Fire Board of Directors considered a position adjustment resolution that incorporated those changes originally directed by the Board as part of the FY 2013-14 Recommended Budget for the Contra Costa Fire Protection District. If adopted, the impact of the resolution would have been the demotion of five employees (one Fire Captain and four Fire Engineers). Prior to taking action on the item, the Board heard public testimony including a petition from labor to delay the position reduction action due to significant attrition expected within the next six months. Additionally, the Board was given a report on Measure H Emergency Medical Services (EMS) funding immediately prior to the the position adjustment report. The Board of Supervisors approved a revision to the funding formula for Measure H Emergency Medical Services funding at their May 14th meeting. The new formula allocates funding on the basis of population rather than per-engine to local fire protection districts. As a result, the Contra Costa County Fire Protection District (CCCFPD) will receive an allocation of $1,487,550 for fiscal year 2013/14. Since the revised formula was presented to and approved by the Board of Supervisors after the 2013/14 budget development process, the increased funding amount is not included in the CCCFPD Recommended Budget. The net increase from the estimated revenue amount included in the Recommended Budget for Measure H is $477,550, representing an increase from $1,010,000 to $1,487,550. The District will continue to provide sufficient paramedic, EMS communication and medical services at the service levels identified in the Recommended Budget to receive Measure H funding. The Board asked staff to consider labor's request in the context of these new revenues and the relatively small additional savings that would be generated by the recommended demotions. Staff met again with Fire District management and labor to discuss the impact of the station closure on employees and agreed to recommend that elimination of filled positions be delayed until January 2014. Due to the high number of over-time hours currently used, the total savings from the Station Closure on July 4 (originally $2,033,845) will be reduced by approximately $150,000. The attached Position Adjustment Resolution (No. 2013/244) incorporates those changes directed by the Board as part of the FY 2013-14 Recommended Budget for the Contra Costa Fire Protection District, modified for anticipated attrition. The impact of this action is that no demotions or lay-offs will be required for the first station closure. It should be noted that in June 2012, the Contra Costa County Fire Protection District received a pass-through payment in the amount of $1,266,279 from the County Auditor-Controller on behalf of the Successor Agency to the Redevelopment Agency of the City of Pittsburg. Earlier this year, the Successor Agency deemed that this distribution violated covenants within bond documents held by the former Pittsburg Redevelopment Agency and requested a refund of the June 2012 pass-through payment made to all affected taxing entities in receipt of the payment. This request was made to several agencies for which the Board of Supervisors serves as the ex-officio governing board, including Contra Costa County, the Contra Costa County Water Agency and the Contra Costa County Fire Protection District. The District is working with the Successor Agency to facilitate repayment of the June 2012 pass-through payment. Additionally, this solution does not resolve the structural imbalance entering fiscal year 2014-15 and additional reductions will be necessary to balance the District’s budget in that fiscal year, absent new revenue. Although the District has made progress in managing the structural deficit, future expenditure increases continue to outpace future revenue increases through fiscal year 2016-17. The County Administrator will continue to work with the District to monitor finances and operations throughout the year and report to the Board should the Recommended Budget need to be amended. Tactical Employment Team Program (TETP) - Attached for reference is a copy of Resolution No. 2008/299, adopted May 6, 2008, which authorized implementation of the Tactical Employment Team Program. The Tactical Employment Team Program (TETP) was reimplemented in 2008 and is still in operation. The objective of this program is to mitigate the negative impact that anticipated layoffs will have on the County and District’s workforce. The team is up and running and will continue to work toward finding employment for as many laid-off individuals as possible. CONSEQUENCE OF NEGATIVE ACTION: Potential delay in elimination of targeted positions, which are not included in the FY 2013/14 Budget. CHILDREN'S IMPACT STATEMENT: None.
