OPEN the public hearing; RECEIVE public comments and protests; CLOSE the public hearing. CONSIDER all protests and FIND that a majority protest does not exist. WAIVE the reading and ADOPT the attached Ordinance No. 22, prescribing the annual sewer service charges for Fiscal Year 2013/2014 in Contra Costa Sanitation District NO. 6, and direct that they be collected on the County assessment roll. DIRECT the Clerk of the Board of Supervisors to deliver, before August 10, 2013, a copy of the Report to the Auditor, as required by Health and Safety Code section 5473.4, and to publish a copy of the ordinance in the Contra Costa Times with the names of the Supervisors voting for and against it within 15 days of its adoption. DIRECT the Auditor-Controller to levy the annual sewer service charges on the tax roll for Fiscal Year 2013/2014. Bueren, Public Works Director/Chief Engineer Date:June 4, 2013 Contra Costa County Subject:HEARING to ADOPT Ordinance No. 22 for Contra Costa County Sanitation District No. 6 (SD 6) Fiscal Year 2013/2014 FISCAL IMPACT: County services to SD 6 are funded entirely by annual sewer service charges obtained from the users of the sewer system, in accordance with the Health and Safety Code 5473. All costs will be 100% covered with revenue from SD 6. BACKGROUND: Sanitation District No. 6 was formed to provide operation and maintenance of the treatment facility in the Stonehurst Subdivision in the unincorporated area of Martinez. The proposed annual sewer service charges are needed to fund and maintain sewer service within Contra Costa County Sanitation District No. 6. On May 14, 2013, the Board of Supervisors accepted filing of the Fiscal Year 2013/2014 Annual Report for SD 6, introduced Ordinance No. 22 to consider the approval of the annual sewer service charges, and fixed June 4, 2013 at 9:30 a.m., in the Board Chambers, as the time and place for a public hearing. The Annual Report contains a description of each parcel of real property receiving sewer service within Contra Costa County Sanitation District No. 6 and the amount of the levy against each parcel for Fiscal Year 2013/2014. CONSEQUENCE OF NEGATIVE ACTION: Without the Board approval, SD 6 will be unable to have the Fiscal Year 2013/2014 sewer service charges collected by the County Tax Collector, and will have to use an alternate method to collect the service charges.
