Approve and authorize the Conservation and Development Director, or designee, to execute a contract amendment
with U.S Communities Compliance Services, to increase the payment limit by $85,000 to a new payment limit of
$560,000 to fund the automatic one-year extension for the period May 6, 2013 through May 5, 2014.
FISCAL IMPACT:
Contract costs will be covered by a combination of federal grant administrative funds (Community Development
Block Grant and HOME Investment Partnership program) and multi-family mortgage revenue bond administrative
funds. No General Funds are used.
BACKGROUND:
The Department of Conservation and Development ("Department") entered into an agreement with U. S.
Communities Compliance Services (“Compliance Services”) on May 6, 2008. Compliance Services licenses a
web-based compliance monitoring and software system that enables property owners and organizations to handle
affordable housing reporting through the Internet. The software runs a series of checks to ensure individual tenants
and the overall property is in compliance with applicable federal, state and local income and rent restrictions.
The Department manages an affordable housing compliance portfolio of 84 multi-family properties - a number which
will grow this year. Historically, the Department devoted approximately 60 percent of a full time Housing Technician
position to multi-family compliance matters. With the implementation of the web-based compliance system the
staffing burden dropped to approximately

25 percent of a full time staff position. In addition, the web-based compliance system brings efficiency to our
non-profit and private sector partners who previously were compiling and submitting hard copy compliance materials
to the County. The implementation made the process of completing federal and state monitoring reports much more
efficient. Equally important, management staff has access to compliance data in a format that is readily available and
easily subject to analysis.
The contract is pursuant to the terms of an underlying Master Intergovernmental Cooperative Purchasing Agreement
and the Master Agreement between Compliance Services and the California Communities Development Authority.
The County is a “participating public agency” and California Statewide Communities Development is the “lead
public agency”.
The initial term of the agreement was five years. Thereafter, the agreement automatically renews for successive one
year periods unless cancelled by written notice of termination at least five (5) calendar days prior to the renewal date.
The software licensing fee for FY 2013/14 is $75,000. Additional funds of up to $10,000 will be needed to add four
new projects.
CONSEQUENCE OF NEGATIVE ACTION:
If the renewal licensing fees are not approved, the County will not have access to the reporting and monitoring
program and additional staff will be required to oversee these matters.
