APPROVE and AUTHORIZE the County Administrator, or his designee to execute a contract between the County
and the Michelson Law Group in an amount not to exceed $100,000 for legal services on behalf of the County on a
case-by-case basis in the area of tax related bankruptcy matters for the period May 1, 2013 through April 30, 2016, as
requested by the County through the Treasurer-Tax Collector, County Counsel, or their respective designees. (100%
General Fund)
FISCAL IMPACT:
Contractor shall receive $300 per hour for legal services rendered by attorneys and $75 per hour for legal services
rendered by Paraprofessionals as compensation for all services. Contractor shall be paid for its actual and reasonable
out-of-pocket expenses necessary in defense of a case. Such expenses include but are not limited to extraordinary
postage and copying, filing fees, witness fees, court fees, investigation fees, service of process fees and other court
related costs, travel, parking, mileage and telephone calls.

BACKGROUND:
As bankruptcy claims in 2008 not only increased as the economy fell into recession, claims became more complex
and beyond the expertise of the Treasurer-Tax Collector’s staff. As a result, the County contracted with a law firm
for legal services and legal representation in tax related bankruptcy matters in August 2008. The Contract
Amendment/Extension Agreement has since expired and the County has elected to discontinue services of the
prior law firm and seek other representation.
CONSEQUENCE OF NEGATIVE ACTION:
The County would not be able to contract for legal services in tax related bankruptcy matters.
