FIND that the appointment of Ms. Lopez is necessary to assist with the transition to new leadership in the Elections Division of the Clerk-Recorder-Elections Department; 3. APPROVE and AUTHORIZE the hiring of County retiree Candy Lopez as a temporary County employee for the period May 8 through December 31, 2013. FISCAL IMPACT: Salary costs are within the Department's operating budget, salary costs will be $28,532 through December 31, 2013. The Act allows the Board, based on finding that the appointment is necessary, to waive the 180 day "sit out" period. On March 29, 2013, Candy Lopez retired from her position as Assistant Registrar, in which capacity she was responsible for the day-to-day operations of the Elections Division. She has over 40 years of expertise in elections. Steve Weir, the elected County Clerk-Recorder, also retired on March 29, 2013. A new Assistant Registrar was appointed to the position on May 6, 2013. He is relocating to Contra Costa County from Utah and is not familiar with current California Election Laws and Contra Costa County procedures. Because of her unique expertise, we are requesting to appoint Ms. Lopez on a temporary basis to provide guidance and training to the new Assistant Registrar on Contra Costa’s election procedures and California Election law affecting election operations. During the training process, Ms. Lopez will oversee the update of the election procedures to incorporate current operations and recent legislative changes. Ms. Lopez will be instrumental in the process to develop a purchase and maintenance contract for new high-speed vote tabulation equipment. This project will involve the acquisition, installation and transition to the new equipment, as well as staff training and procedures development. The Elections Division is currently preparing for the June 4, 2013 Special Election, as well as the November 5, 2013 Election. Preparation for a major election begins 180 days before Election Day and runs for four to six weeks after Election Day. The requested waiver of the 180-day sit out period will allow Ms. Lopez to assist part time with training throughout the entire election process for the November 2013 election. CONSEQUENCE OF NEGATIVE ACTION: Failure to provide adequate training and a successful transition could cause there to be a problem with the elections process, which would damage the integrity of the election.
