APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the Bailey Road Maintenance
Surcharge Disbursement Agreement between Contra Costa County and the City of Pittsburg for the maintenance
surcharge disbursement for Bailey Road, and AUTHORIZE the establishment of a permanent, interest-bearing
Special Revenue Fund account for the deposit and disbursement of surcharge collected, Pittsburg and Bay Point
areas. (District V)
FISCAL IMPACT:
No fiscal impact to this action. Future disbursements will be paid from the Special Revenue Fund account established
by the Bailey Road Maintenance Surcharge Disbursement Agreement.
BACKGROUND:
County Land Use Permit 2020-89 required the Keller Canyon Landfill to impose a surcharge to fund the maintenance
of Bailey Road between the Highway 4 interchange and the entrance to the Keller Canyon Landfill. The County and
the City coordinated and established the amount of surcharge to be collected to maintain Bailey Road based on the
Landfill’s truck traffic impacts.

BACKGROUND: (CONT'D)
Board of Supervisors approved the established amount of surcharge necessary. Since the surcharge has been
established, the Department of Community Development has been collecting surcharge funds and transferring
these funds to the Public Works Department until such time that an agreement between the City and the County is
established. The Bailey Road Improvement Disposal Surcharge was collected from Keller Canyon Landfill
pursuant to Condition of Approval 29.7 of Keller Canyon Landfill Land Use Permit 2020-89.
The Bailey Road Maintenance Surcharge Disbursement Agreement establishes the method for disbursement and
allows the transfer of fees to the City of Pittsburg collected from Keller Canyon Landfill for the maintenance of
Bailey Road.
CONSEQUENCE OF NEGATIVE ACTION:
The disbursement agreement would not be approved and the City of Pittsburg’s share would not be disbursed to
the City of Pittsburg for the maintenance of Bailey Road. Fees collected would remain in the temporary Special
Revenue account.
