CONSIDER waiving the 180 day “sit out” period for Mr. Ed Swan, Vegetation Management Supervisor in the
Maintenance Division of Public Works;

FIND that the appointment of Mr. Swan is necessary to fill a critically needed position; and2.
APPROVE AND AUTHORIZE the hiring of County retiree Ed Swan as a temporary County employee for the
period of April 1, 2013 through December 31, 2013, as recommended by the Public Works Director.

FISCAL IMPACT:
No additional fiscal impact. Salary costs are included in the Department’s operating budget.

Subject:Temporary Hire of County Retiree – Waiver of 180 day “sit out” period
BACKGROUND:
The Public Employee Pension Reform Act of 2013 requires that active members who retire on or after January 1,
2013 must wait 180 days after retirement before returning to work as a temporary employee. The Act also allows the
Board, based on a finding that the appointment is necessary to fill a critically needed position, to waive the 180 day
"sit out" period.
Mr. Swan will be retiring from the Public Works Department effective March 29, 2013. He serves as the Public
Works Vegetation Management Supervisor within the Maintenance Division. This position requires a California
Department of Pesticide Regulation Pest Control Adviser (PCA) license with all of the required categories to legally
write recommendations for vegetation management using IPM principles. A PCA license with all of the required
categories is needed to make and approve the various pesticide recommendations that the crew applies along the
roadsides and flood control facilities to control weeds that can affect roadway safety and flood hazards in the flood
control channels. The Department does not have any other staff that can complete these recommendations and also
possesses the historical knowledge of the various County areas and needs within those areas.
In addition, the Department has been establishing a succession planning effort for this work within the Department
and is currently in the process of recruiting vegetation management staff for this unit. Mr. Swan’s knowledge and
expertise will be critical as this succession planning is on-going and will require an additional recruitment effort to
permanently fill his position, as well as others, as soon as possible after his retirement. Based on previous
experience, recruitment for these types of positions requiring this kind of licensing have been difficult with limited
applicants applying for positions. Our Department will immediately begin working with County Human Resources
staff to start a recruitment for this and the other vacant positions. Mr. Swan will work full time.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to receive Board approval will not allow the Department to properly manage the vegetation within the road
and flood control areas.
