HomeMy WebLinkAboutMINUTES - 09091986 - T.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T.8 Adopted this Order on ; September 9 , 1986 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, and Powers NOES: Supervisor Torlakson ABSENT: None ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Hearing on Rezoning Application 2679-RZ , Development Plan 3030-86 , and Tentative Subdivision Map #6779 filed by Perma Bilt Homes and John & Doris Clinch in the Walnut Creek area. This being the time set for hearing on the recommendation of the Contra Costa County Planning Commission with respect to the applications filed by Perma Bilt Homes (applicant) and John and Doris Clinch (owners) to rezone land in the Walnut Creek area from Single Family Residential District (R-10) and Multiple Family Residential District (M-12) to Planned Unit District (P-1 ) (2679-RZ) and for approval of Development Plan 3030-86 for 187 residential units for senior housing and tentative subdivision map (Subdivision #6779) in the Walnut Creek area; and Harvey Bragdon, Director of Community Development, described the property site and advised that a Negative Declaration of Environmental Significance was posted for this project; and The Chairman opened the public hearing. No one appeared to speak. The Chairman closed the public hearing. The Board discussed the matter. Supervisor Schroder recommended approval of the rezoning and development plan and tentative subdivision map. Supervisor Torlakson proposed an amendment to the motion with respect to the proposed project and proposed- policy on police services. The pro- posed amendment died for lack of a second. On the recommendation of Supervisor Schroder, IT IS BY THE BOARD ORDERED that rezoning aplication 2679-RZ and Development Plan No. 3030-86 are APPROVED subject to conditions (Exhibit A attached hereto and by reference made a part hereof) , and tentative sub- division map for Subdivision 46779 is APPROVED subject to conditions (Exhibit B attached hereto and by reference made a part hereof) , and the Board hereby adopts the Planning Commission's reasons, set forth in its Resolution Number 41-1986 as its determinations for this decision. IT IS FURTHER ORDERED that Ordinance Number 86-82 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and September 23, 1986 is set for adoption of same. The permit is . approved per plans submitted with the application dated received by the Community Development Department May 30, 1986, subject to the conditions listed below. 2. This approval shall be for senior housing and a retirement complex for residences of persons 60 years or older and as such shall be recorded as a deed restriction on the property. A copy of the recorded document shall be submitted to the Community Development Department prior to occupancy. A 25 precent density bonus beyond that indicated by the General Plan for persons 60 years of age or older, shall be permitted with this approval . 3. Prior to the issuance of building permits, building elevation and architectural design of the building and any accessory structures, fencing, etc. , shall be subject to review and approval by the Zoning Administrator. The roofs and exterior walls of the building shall be free of such objects as air conditioning equipment, television aerials, etc. , or screened from view. Building design and materials shall be considered with the intent to provide compatibility with the residential character of this area. 4. Prior to issuance of a building permit a landscape and irrigation plan similar to that submitted with the application shall be submitted for review and approval by the Zoning Administrator giving special attention to extensive planting to the street frontage of Tice Valley Boulevard and at the east boundary in the vicinity of adjacent residences. .5. Development of the site shall be consistent with the geotechnical feasibility study of ENGEO Inc. , September 9, 1985. Grading plans shall be subject to review and approval by the Zoning Administrator prior to issuance of a grading permit. 6. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 7. Development rights for the hillside open space areas shall be deeded to the County with filing of the Final Subdivision Map. 8. Signs shall be subject to review and approval by the Zoning Administrator, 9. Provide complete automatic fire sprinkler protection and smoke exhaustion system for the entire building subject to approval by the Contra Costa County Consolidated Fire District. � � LD)�� Q 3030-86 Pg. 2 10. Submit a TSM (Transportation System Management Program) for vans, busing', etc. , for' review and approval by the Zoning Administrator prior _to occupancy: Serious consideration shall be given to providing van serv.ic.e for residents. 11. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. Requirements of the Ordinance include the following: 1) Construction of a 6-foot 6-inch sidewalk along the frontage of Tice Valley Boulevard. B. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. C. Construct the on-site driveway system to current County private road standards with a minimum width of 16 feet. D. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. E. Comply with the drainage fee requirements for Drainage Area 15A as adopted by the Board of Supervisors. F. Contribute $190 per residential unit to a Road Improvement Fee Trust (Fund No. 819200-0800) designated for road improvements to Tice Valley Boulevard and Olympic Boulevard, including improvements to the intersection of Tice Valley Boulevard and Olympic Boulevard. G. Contribute $3,000 to a Road Improvement Fee Trust (Fund No. 819200-0800) designated for restriping of Tice Valley Boulevard to provide for a two-way left-turn lane. H. Prior to issuance of building permits, file the Final Map for Subdivision 6779. 12• Soundproofing for the residential units .shall be provided for those units facing Tice Valley Boulevard. 3030-86 Pg. 3 The following statements are not conditions of approval . This approval _ is based upon this tentative map submitted with this application, dated received by the Community Development Department May 30, 1986. The topography and layout of our project make vehicle access to ' several areas very impractical. Rather than' providing a paned aooeoo to within 150 feet of all portions of the exterior walls of every building, it was agreed that the following features will be an acceptable alternative to such access: l.
