Adopted this Order on September 9 , 1986 , by the following vote:

SUBJECT: Hearing on Rezoning Application 2681-RZ and Devlopment
Plan 3031-86 Filed by D.B. Construction Co. and Nellis &
Grant Byer, E1 Sobrante area.
This being the time for hearing on recommendation of the
Contra Costa County Planning Commission with respect to the applica-
tion filed by D.B. Construction Co. (applicant) and Nellis and Grant
Byer (owners) (2681-RZ) to rezone land in the El Sobrante area from
Single Family Residential District (R-7) to Retail Business District
(R-B) together with Development Plan 3031-86 to establish retail and
office uses on the property; and
Harvey Bragdon, Director of Community Development,
described the property and advised that a Negative Declaration of
Environmental Significance was posted on these applications;and
The Chairman opened the public hearing. No one appearing
to speak, the Chairman closed the public hearing.
Supervisor Fanden recommended approval according to the
staff report.
Board members considered the matter. IT IS ORDERED BY THE
BOARD that rezoning application 2681-RZ is APPROVED as recommended
by the County Planning Commission and that Development Plan 3031-86
is also APPROVED subject to conditions imposed by the Planning
Commission and the Board of Supervisors as set forth in Exhibit A
attached hereto and by reference incorporated herein, and the Board
hereby adopts the Planning Commission' s reasons, set forth in its
Resolution Number 40-1986 as its determinations for this decision.
IT IS FURTHER ORDERED that Ordinance Number 86-81 giving
effect to the aforesaid rezoning is INTRODUCED, reading waived and
September 239 1986 is set for adoption of same.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3031-86:
1. Development shall be generally as shown on the plan submitted t;ith the
application and dated May 12, 1986 by the Community Development
Department and these conditions of approval . Development shall be
subject to final review and approval by the County Zoning Administra-
tor prior to issuance of a building permit.
2. Comply with the landscape and irrigation requirements as follows:
A. At least 30 days prior to issuance of a building permit, a
landscape and irrigation plan shall be submitted for review and
approval by the County Zoning Administrator. A cost estimate or
copy of contract for landscaping improvements shall be submitted
with the plan. Landscaping and irrigation shall be installed
prior to occupancy of the building.
B. The proposed trees on the site are to be a minimum of 15 gallons
in size. ' The proposed shrubs on the site are to be a minimum of
5 gallons in size.
C. The planter along the northerly property line shall be widened to
6 feet to provide space for a row of trees. Vehicles may over-
hang 2 feet into the planter.
D. Drought tolerant and/or native plant species shall be used as
much as possible.
E. The back p'rop'erty line, and the northerly property line to the
back of the neighboring building, shall be fenced with a 6-foot
high solid wood fence. This condition can be modified subject to
Zoning Administrator review and approval .
F. The applicant shall work out landscaping behind the building
with the neighboring property owners and subject to Zoning
Administrator review and approval . A narrow planter at the front
of the building shall be established for bushes and vine plants.
G. The applicant shall contact the neighboring owner to see if a row
of trees can be planted along the back of the building. The
trees shall be properly irrigated and a maintenance easement
shall be established. This condition can be deleted if the
neighboring property owner indicates in writing that they do not
want the row of trees established. A suggested spacing for the
trees is 20 feet.
H. Trees along the frontage of the site shall be of a type that will
grow to a significant size.

3. Prior to issuance of a building permit, elevations and examples of
exterior colors and materials for buildings and structures shall be
subject to final review and approval by the County Zoning Administra-
tor. The roofs and exterior walls of the buildings shall be free of
such objects as air conditioning equipment, television aerials, etc. ,
or screened from view. Building and doors shall be of an earth tone
color and there shall be no unpainted exposed metal . The final color
scheme shall be subject to Zoning Administrator review and approval
prior to building permit issuance.
A. Roof equipment shall be screened as much as possible from view by
the houses immediately uphill of the site.
B. A revised exterior design shall be submitted for the review and
approval of the Zoning Administrator. The design shall include
additional brick and wood accent material , and a revised treat-
ment to help soften the rectangularly of the building. The
design shall be an acceptable architectural treatment to help
break up the effect of the long blank southerly wall of the
building.
4. Exterior lights shall be deflected so that lights shine onto appli-
cant's property and not toward adjacent properties. The Zoning
Administrator shall review and approve lighting details prior to
issuance of building permits.
5. No outdoor storage of materials shall be allowed.
6. A sign program shall be developed for the site. The Zoning Adminis-
trator shall review and approve the sign program. One project identi-
fication sign will be allowed in the planter at the front of the
project, subject to review and approval of the Zoning Administrator.
The project identification sign shall be a monument type of sign. No
flags, pennants, banners, pinwheels or similar items shall be permit-
ted on the premises with the exception of the United States or State
of California flags.
7. The developer and the neighboring owner to the north shall execute
cross easements for parking purposes so the patrons of each building
can park in either parking lot.
S. Comply with the requirements of the West County Fire District.
9. If archaeologic materials are uncovered during grading, trenching or
other on-site excavation, earthwork within 30 meters of these materi-
als shall be stopped until a professional archaeologist who is certi-
fied by the Society for California Archaeology (SCA) and/or the
Society of Professional Archaeology (SOPA) has had an opportunity to
evaluate the significance of the find and suggest appropriate mitiga-
tion measures, if they are deemed necessary.
10. There shall be two property sized and signed handicapped parking
spaces provided.

11. Refuse areas shall be properly screened from view.
12. Any restaurants, bars or night clubs will require approval of a new
development plan.
13. I,f a video game center is established, provisions shall be made for
bicycle parking. The Zoning Administrator shall review and approve
the location and number of bicycle parking spaces required.
14. Parking areas shall be paved and sloped to prevent the ponding of
water.
15. Comply with drainage, road improvement, traffic and utility require-
ments as follows:
A. In accordance with Section 82-2.014 of the County Ordinance Code,
this development shall conform to the requirements of Division
914 (Drainage) of the Subdivision Ordinance, unless exceptions
are specifically granted.
B. Unless exceptions are specifically granted, comply with the
requirements of Division 1006 (Road Dedication and Setbacks) of
the County Ordinance Code. This includes the following:
1) Convey to the County, by Offer of Dedication, additional
right of way on Appian Way as required for the planned
future width of 80 feet.
2) Construct curb, 6-foot 6-inch sidewalk (width measured from
curb face) , necessary longitudinal and transverse drainage,
and necessary pavement widening on Appian Way. The face of
curb shall be located 8feet from the widened right of way
line.
3) Install street lights on Appian Way. The final number and
location of the lights shall be determined by the County
Traffic Engineer.
C. Install all new utility distribution services underground.
D. Prevent storm drainage, originating on the property and conveyed
in a concentrated manner, from draining across the sidewalk and
driveway.
E. Furnish proof to the Public Works Department, Engineering Servic-
es Division, of the acquisition of all necessary rights of entry,
permits and/or easements for the construction of off-site,
temporary or permanent, road and drainage improvements.

F. Submit improvement plans prepared by a registered civil engineer
to the Public Works Department, Engineering Services Division,
for review; pay the inspection, plan review and applicable
lighting fees. These plans shall include any necessary traffic
signage and striping plans for review by the County Traffic
Engineer. The improvement plans shall be submitted to the Public
Works Department, Engineering Services Division, prior to the
issuance of any building permit. The review of improvement plans
and payment of all fees shall be completed prior to the clearance
of any building for final inspection by the Public Works Depart-
ment. If final inspection is requested prior to construction of
improvements, the applicant shall execute a road improvement
agreement with Contra Costa County and post bonds required by the
agreement to guarantee completion of the work.
G. Comply with the requirements of the Bridge/Thoroughfare Fee
Ordinance for the Richmond/E1 Sobrante as adopted by the Board of
Supervisors.
H. Comply with the drainage fee requirements for Drainage Area 73 as
adopted by the Board of Supervisors.
