APPROVE Notice of Intention to assign an easement to the Town of Danville over a portion of Assessor’s Parcel
Numbers 216-120-028 for flood control purposes for San Ramon Creek pursuant to Government Code Section
25365.
DECLARE that this Board will meet on May 7, 2013 at 9:00 a.m. or thereafter, in the Board’s Chambers, County
Administration Building, Martinez, California, to consummate the assignment.
DIRECT the Clerk of the Board to publish the notice in the Contra Costa Times pursuant to Government Code
Section 6061.
FISCAL IMPACT:
The activity is funded by the Flood Control Permit Number 611-11.

Subject:APPROVE Notice of Intention to assign an easement to the Town of Danville, Danville area.
BACKGROUND: (CONT'D)
Water Conservation District (District) has issued a Flood Control Encroachment Permit to the Town of Danville
(Danville) for work associated with the Diablo Road Slope Repair Project (Project). The Project will repair
erosion along the San Ramon Creek within a portion of the District’s existing easement and requires the
assignment of a portion of the District’s easement to Danville.
CONSEQUENCE OF NEGATIVE ACTION:
Danville would not have the necessary land rights for its erosion repair project.

NOTICE OF INTENTION TO ASSIGN EASEMENT
The Board of Supervisors of Contra Costa County declares its intention to assign an
easement to the Town of Danville for creek maintenance rights and appurtenances thereto
located over a portion of Assessor’s Parcel Number 216-120-028 in connection to the Diablo
Road Slope Repair Project. A description of the proposed easement to be assigned is
available at the Contra Costa County Public Works Department, 255 Glacier Dr., Martinez,
CA. The Board will meet on Tuesday, May 7, 2013 at 9:00 a.m. in its Chambers, County
Administration Building, 651 Pine Street, Martinez, California, to consummate the
assignment.
