BACKGROUND Last month, in response to the federal government's across the board budget cuts known as sequestration, the Board approved new payment standards effective April 1, 2013 for the housing choice voucher program. This change was made in an attempt to prevent the possibility that HACCC will have to terminate housing assistance to families currently on the voucher program before the end of the 2013-2014 fiscal year. The payment standards were reduced to 90% of the applicable Fair Market Rents (FMRs), the lowest level allowed by HUD without a waiver. Each PHA must establish a schedule of payment standard amounts by bedroom size. The range of possible payment standard amounts is based on HUD’s published FMR schedule for the statistical area within which the PHA has jurisdiction. HACCC’s payment standards are based on the FMRs for the Oakland-Fremont, CA HUD Metro FMR area which includes all of Alameda and Contra Costa Counties. FMRs are based on the 40th percentile of rents charged for standard housing in the FMR area. This is the dollar amount below which 40 percent of the standard-quality rental housing units are rented. PHAs may set their payment standards amounts from 90% to 110% of the published FMRs without HUD approval. Payment standards can be set higher or lower than this range in response to market conditions with HUD approval. When calculating payment standards, PHAs do not follow what is known as the common method of rounding where one rounds down if the next digit is less than 5 and up when the next digit is 5 or more. Instead, the 90% level can be thought of as an absolute floor and calculations can only be rounded down to that level and not up. For example, if the FMR is $1,901, a PHA would not be permitted to have a payment standard of $1,710 because that would be 89.95% of the FMR. The PHA's minimum payment standard would have to be $1,711, or 90.01% of the FMR. The process is reversed for payment standards at 110% of the FMR. In that case 110% would serve as a hard ceiling and a PHA could not choose a value that had to be rounded down to 110%. HUD provides zero- to four-bedroom FMRs annually to PHAs in a notice published in the federal register. HUD also provides a formula to use in deriving larger bedroom FMRs. However, unlike payment standards, HUD does not provide guidance on the rounding method that should be used in deriving the value of the five-bedroom or larger FMRs. Because funding levels are so tight this year, HACCC has been in conversations with local HUD staff to provide clarification on the rounding method that should be used for deriving FMRs so that HACCC can shave subsidy levels as close as possible without running afoul of HUD's regulations. Earlier this month local HUD staff clarified that, unlike with the payment standards, HACCC should use the common method of rounding when deriving FMRs. Thus, HACCC will round down if the adjacent value is less than 5 and up when the adjacent value is 5 or more. As a result of this clarification, the FMRs and payment standards for five and six bedroom units should each be increased by $1. The corrected values are shown below. These changes affect approximately 221 families currently on HACCC's voucher program. Local HUD staff said these changes can be retroactive to April 1,2013. This value is $544. HACCC's proposed payment standard for manufactured home space rentals is set at 100% of the FMR, or $544. This is because HACCC has traditionally set this payment standard at 100% of FMR and at this time there are no households that receive the manufactured home space rental payment standard. If this payment standard is needed, staff will analyze whether this level appears to be too high or low based on relevant market data. FISCAL IMPACT Implementation of these payment standards will allow the Housing Authority (HACCC) to save approximately $2.7 million annually by reducing the subsidy each family receives. This will provide funding for approximately 225 vouchers. CONSEQUENCE OF NEGATIVE ACTION Should the Board of Commissioners not approve the recommended payment standards, HACCC will be more likely to terminate assistance to families currently on the program due to federal funding shortages. April 16, 2013 Contra Costa County Housing Authority Minutes 28 C.2 To:Housing Authority Bd of Commissioners From:Joseph Villarreal, Housing Authority Date:April 16, 2013 Contra Costa County Subject:Reduction of Interest Rate in Terms of Agreement for Purchase of 2870 Howe Road RECOMMENDATIONS RECEIVE report regarding the change in terms with Westamerica Bank for the Housing Authority's purchase of the Housing Choice Voucher office, located at 2870 Howe Road, Martinez, CA. BACKGROUND On December 12, 2006 the Board authorized the Executive Director to execute all documents pertaining to the purchase of the Howe Road property for $3,375,000. This building houses the majority of HACCC’s housing choice voucher (Section 8) staff. A purchase agreement was executed on December 15, 2006. The interest rate for the original purchase agreement was fixed at 7.25%. At HACCC’s request this rate was reduced to a fixed rate of 6.75% effective April 28, 2008 and to 6.00% on December 1, 2011 in response to decreased lending rates. Ongoing decreases in lending rates prompted staff to again approach Westamerica Bank about reducing the interest rate of the loan. Effective January 9, 2013, Westamerica reduced the rate to 5.25%. Taken together, these changes in loan terms have reduced annual payments by $43,801.08. The savings will be utilized to either offset costs in the Housing Choice Voucher program or to reduce the remaining loan balance. All other terms of the Purchase Agreement remain the same. A copy of the Change in Terms of Agreement is attached.
