APPROVE Appropriations and Revenue Adjustment No.5069 authorizing new revenue in the amount of $100,000
from the National Prison Rape Elimination Act (PREA) Resource Center for training and implementation of PREA
standards within county juvenile detention facilities.
FISCAL IMPACT:
This action increases revenue and appropriations by $100,000. No match is required.
BACKGROUND:
The Prison Rape Elimination Act (PREA) was signed into law (Public Law 108-79) by President George W. Bush on
September 4, 2003. The goal of PREA is to eradicate sexual assaults in all "correctional" facilities in the United
States. In addition to providing federal funding for research, programs, training, and technical assistance to address
the issue, the legislation mandated the development of national standards. The final version of the standards was
issued by the Department of Justice on May 17, 2012. PREA required the Department of Justice to issue standards
outline the steps that facilities must take

Standards
BACKGROUND: (CONT'D)
to address sexual misconduct prevention, detection, and response. On June 20, 2012, the Department of Justice
officially published the final standards for four types of facilities: juvenile facilities, adult prisons and jails,
lockups, and community confinement facilities. PREA standards include detailed: Prevention Planning, Training
and Education, Screening, Reporting, responding to Misconduct, Investigations, Discipline, Medical and Mental
Health Care, Data Collection and Review, and Audits.
On March 28, 2013 the Probation Department was notified that the National PREA Resource Center approved the
'Establish "Zero Tolerance" Cultures for Sexual Abuse in Local Adult and Juvenile Detention Facilities' grant
proposal. The Probation Department will use the new revenue of $100,000 to fund a PREA Coordinator, two
PREA Compliance Managers (one at the Juvenile Hall and one at the Byron Boys Ranch), an outside consultant
who will provide staff training and Contra Costa Television (CCTV) who will develop a resident orientation
video. The grant is for the period April 1, 2013 through March 31, 2014.
CONSEQUENCE OF NEGATIVE ACTION:
The new revenue and associated expenditures will not be properly recognized in the department operating budget.
