APPROVE a Lease with Flavio Hernandez for a five-year term for the County owned property located at 5830
Pacheco Boulevard, for use as a drive-thru restaurant, under the terms and conditions set forth in the Lease. Local
Road Fund 06766P0040.
AUTHORIZE the Public Works Director, or designee, to EXECUTE the Lease on behalf of the County and to
EXERCISE any options to extend the Lease.
FISCAL IMPACT:
The Lease will generate $144,800 over the term and renewal terms of the lease to the local road fund.
BACKGROUND:
In 1988 the County leased the 18,043 square foot property located at 5830 Pacheco Boulevard to Sylvia Schireck.
The property was improved with an 870 square foot building that was used as a drive thru restaurant. On June 14,
2012 the County and Ms. Schireck terminated the lease for the property. The County advertised the

BACKGROUND: (CONT'D)
property for lease and accepted lease proposals from interested parties and found Mr. Hernandez’s proposal for a
drive thru taqueria restaurant to be the best suited use for the property and in the best interest of the County and the
surrounding neighborhood.
Mr. Hernandez will be responsible for the maintenance and repairs to the building including HVAC and for the
maintenance and repairs to the parking area and exterior lighting.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to approve the Lease may result in having to find new a lessee for the property, which may result in higher
cost to the County.
