1.WAIVE the 180-day "sit-out period" for Neal Price, Hazardous Materials Specialist II, Health Services
Department;
2. FIND that the appointment of Mr. Price is necessary to fill a critically needed position;
3. APPROVE and AUTHORIZE the hiring of county retiree Neal Price as a temporary County employee for the
period March 13, 2013 through December 31, 2013, as recommended by the Health Services Department Director.
FISCAL IMPACT:
If the request is granted there will continue to be salary and employment tax payments for the hours provided of
approximately $45,127. These costs will be offset by savings due to the vacancy of the permanent position. For 960
hours, the net savings is approximately $65,000.

Subject:Request to Waive 180-day Sit-Out Period for County Retirees
BACKGROUND:
Under the Public Employees' Pension Reform Act of 2013 (PEPRA), an active member who retires on or after
January 1, 2013 must wait 180 days after retirement to return to work. The 180-day waiting period does not apply
to retirees who are firefighters or public safety officers returning to work.
The Board has some discretion to waive the 180 day waiting period. This sit-out period will not apply if:
1. The Board of Supervisors certifies the nature of the employment, and
2. The appointment is necessary to fill a critically needed position before 180 days have passed, and
3. The appointment has been approved by the Board of Supervisors in a public meeting. The appointment may
not be placed on a consent calendar. Therefore, the Board Order seeking approval must be on the Short Discussion
portion of the Board’s agenda.
The Health Services Department has submitted a request for an exemption to the 180 sit-out rule for Neal Price,
Hazardous Materials Specialist II. Mr. Price retired on February 22, 2013. Please see the attached request memo.
Under current Contra Costs County Employees Retirement Association (CCCERA) rules, if a CCCERA retiree
returns to work for a CCCERA covered employer, the retiree can work for 960 hours or less per fiscal year. This
rule continues to apply.
CONSEQUENCE OF NEGATIVE ACTION:
The Health Services Department will be unable to fill this position, train new staff, and perform inspections until
the position can be backfilled.
