FIND that the appointment of Mr. Goetz is necessary to fill a critically needed position; 3. APPROVE and AUTHORIZE the hiring of county retiree Steven Goetz as a temporary County employee for the period April 1, 2013 through December 31, 2013, as recommended by the Conservation and Development Director. FISCAL IMPACT: There will be no impact to the County General Fund. Salary costs are included within the Department's operating budget and will be 67,000 lower over the nine month period through December 31, 2013. The Act also allows the Board, based on a finding that the appointment is necessary to fill a critically needed position, to waive the 180 day "sit out" period. Mr. Steve Goetz will be retiring effective March 30, 2013. Mr. Goetz is currently the Deputy Director for Transportation, Conservation Programs and Redevelopment Programs. Mr. Goetz assumed responsibility of the wind down of the County's Redevelopment Agency as well as the Successor Agency responsibilities, activities that were in addition to his previous role overseeing transportation and conservation programs. The wind down of the Redevelopment Agency and compliance with the Dissolution Act is very complex. During this period, Mr. Goetz will be responsible for: 1. Obtaining a Finding of Completion for the Successor Agency from the State Department of Finance (DOF) for meeting certain provisions of the Redevelopment Dissolution Act which will enable the Successor Agency to avoid audit findings that could put the County's sales and use tax at risk and enable the Successor Agency to spend seven million dollars in unspent bond proceeds of the former Redevelopment Agency. This includes concluding the Meet and Confer process if the DOF determines that payments from the Successor Agency is required. 2. Obtaining approval from the DOF of the Recognized Obligations Payment Schedule for July to December 2013. This includes the conclusion of Meet and Confer with the State Department of Finance. 3. Negotiating garbage rate agreements with Richmond Sanitary and the West Contra Costa Integrated Waste Management Authority which is currently underway and will continue during the next six months. 4. Coordinating with the Central Contra Costa Solid Waste Authority on the new franchise agreement process which is currently underway. With Mr. Goetz's retirement, the Department will be requesting a recruitment to fill the vacancy. The Department expects the recruitment and hiring to take approximately 6-8 months which allows some additional weeks for training and transition. The wind down of the Redevelopment Agency and compliance with the Dissolution Act is very complex. The loss of the Deputy Director with critical financial and project management capabilities will severely impact the ability of the Department to carry out these important duties. As such, the Department requests the temporary hire of Mr. Steven Goetz through December 31, 2013 to allow for recruitment and transition. CONSEQUENCE OF NEGATIVE ACTION: Failure to receive Board approval may jeopardize the successful implementation of the Dissolution Act by the Successor Agency.
