HomeMy WebLinkAboutMINUTES - 03122013 - C.18RECOMMENDATION(S): RECEIVE public report of litigation settlement agreements that became final during the period of February 1, 2013 through February 28, 2013, as recommended by County Counsel. FISCAL IMPACT: Settlement amounts are listed below. BACKGROUND: One agreement to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of February 1, 2013 through February 28, 2013. Pistone v. County of Contra Costa (CCC Sup. Ct. Case No. C11-02264). This is a premises liability case. The plaintiff alleged she tripped when entering an elevator in a County-owned building and alleged she suffered a partially torn gastrocnemius muscle. As part of a settlement and release agreement, the Board of Supervisors authorized payment of $60,000 to the plaintiff, inclusive of attorney fees and costs. The Board authorized settlement on January 15, 2013, in closed session, by a 5-0 vote. The settlement became final on February 26, 2013.
