APPROVE and AUTHORIZE the Chair, Board of Supervisor’s or designee, to execute a Temporary Construction
and Access Easement, on behalf of the Contra Costa County Flood Control and Water Conservation District, for a
temporary stockpile and pipeline protection area with Aviano Farms LLC., identified as a portion of APN
057-030-005 effective March 1, 2013 through March 31, 2014 for the Upper Sand Creek Basin Project, Antioch
Area. Project No.: 7562-6D8518.
APPROVE payment of $3,000.00 for said property rights and AUTHORIZE the Auditor-Controller to issue a check
in said amount payable to Aviano Farms, LLC. to be forwarded to the Real Estate Division for delivery.
DIRECT the Real Estate Division to have the above referenced Temporary Construction Easement recorded in the
Office of the County Recorder.
FISCAL IMPACT:
Payment of $3,000 from Drainage Area 130 funds.

Subject:Temporary Construction Easement for Upper Sand Creek Basin Project, Antioch area.
BACKGROUND:
The Contra Costa County Flood Control and Water Conservation District (District) plans to expand the Upper
Sand Creek Basin (USCB) located in the southeast portion of the City of Antioch, south of Lone Tree Way and,
east of Deer Valley Road. In 1992, this Board as governing Board of the District, approved the Final EIR for Sand
Creek watershed improvements. This EIR considered eight alternatives made up of various detention basin sites
throughout the watershed. After careful consideration, the Board chose Alternative 8, which included USCB in its
current location.
Phase One of the USCB was constructed in 1994 as part of Assessment District 27 in Antioch. The interim USCB
currently receives local runoff from the adjacent subdivisions. The expansion will provide regional flood
protection benefits for downstream communities. The USCB expansion project consists of excavating soil from
the existing interim basin to create a deeper basin for holding storm water during major storm events, then slowly
releasing this storm water though the outlet pipe; reducing peak flows downstream in both Sand and Marsh
Creeks. The project will expand the interim basin to its ultimate size. The Temporary Construction Easement will
allow the District to have a soil stockpile and pipeline protection area during the expansion of the basin.
A Notice of Determination was filed and Posted on September 14, 1992, [CP#88-69, SCH 90030280].
CONSEQUENCE OF NEGATIVE ACTION:
The District will not have sufficient rights for the construction phase of the project and will not be able to expand
USCB to its ultimate configuration.
