ATTESTED: February 5, 2013 David Twa, BY:Carrie Del Bonta , Deputy RECOMMENDATION(S): APPROVE the conveyance of real property from Contra Costa County Flood Control and Water Conservation District (District) to Contra Costa County (County), in accordance with the Purchase and Sale Agreement and pursuant to Government Code Section 25365. DETERMINE said property to be surplus and no longer necessary for District purposes and is required by County for County purposes. RECOMMENDATION(S): (CONT'D) AUTHORIZE the Board Chair, or designee, to execute the Purchase and Sale Agreement and Grant Deed on behalf of the District. ACCEPT the Grant Deed from District, and AUTHORIZE the Board Chair, or designee, to execute the Purchase and Sale Agreement on behalf of the County. AUTHORIZE the Auditor-Controller to issue a check in the sum of $225,000 made payable to Contra Costa County Flood Control and Water Conservation District. DIRECT the Real Property Division of the Public Works Department to cause said Grant Deed to be recorded in the office of the County Recorder. FISCAL IMPACT: Payment of $225,000 to District Fund 7505-6F8338 from County Park Dedication funds designated for unincorporated North Richmond. BACKGROUND: District acquired the 5.9 acre property located 323 Brookside Drive in the North Richmond area on November 26, 1989 for Flood Control purposes as part of the San Pablo Creek project. Since the completion of the San Pablo Creek Project, the District no longer requires 3.13 acres of the property for Flood Control purposes. County has determined that the property could be used best for County purposes and wishes to purchase the property from the District. CONSEQUENCE OF NEGATIVE ACTION: The property will not be purchased by the County and used for County purposes. CHILDREN'S IMPACT STATEMENT: Not applicable.
