APPROVE and AUTHORIZE the Pubic Works Director, or designee, to execute Amendment No. 1, effective
December 31, 2012, to an existing contract with Smith, Watts & Martinez, LLC, effective January 1, 2011, to extend
the termination date from December 31, 2012 to December 31, 2013, and increase the payment limit by $56,000 to a
new payment limit of $156,000, Countywide.
FISCAL IMPACT:
All costs associated with this contract will be funded by Local Road Funds 100%.
BACKGROUND:
The Public Works Department did outreach in 2010 and conducted interviews on November 10, 2010. After a
thorough search, a two year contract was awarded to Smith, Watts & Martinez, LLC (formerly Smith, Watts and
Company, LLC) for the amount of $100,000 to provide legislative monitoring and advocacy in Sacramento on
transportation and related matters. The original contract expires on December 31, 2012. At this time, Public Works
would like to amend the Payment Limit by $56,000 and extend the contract by one year, to expire on December 31,
2013, to continue this service through 2013. A new solicitation and outreach will be performed in the fall of 2013.

CONSEQUENCE OF NEGATIVE ACTION:
If the contract amendment is not approved, Public Works will not have legislative monitoring and advocacy in
Sacramento for the 2013 calendar year and would be left at a great disadvantage in the areas of growth
management, infrastructure finance, transportation finance, planning and zoning (including transportation
planning), public works contracting, community development and redevelopment, energy restructuring and
associated administrative issues in relation to the State legislative, state executive and regulatory agencies.
