Acting as the Governing Board to the Successor Agency for the Contra Costa County Redevelopment Agency,
ADOPT Resolution 2012/490 authorizing the Successor Agency to execute a Second Amendment to the Public
Improvements Agreement for the Rodeo Marina Sewer Expansion Project with the Rodeo Sanitary
District, increasing the payment limit by $175,000 from $1,559,000 to a new payment limit of
$1,734,000, and extending the amended termination date of January 31, 2013 to a new termination date of December
31, 2013.
FISCAL IMPACT:
No impact to the General Fund. $1,559,000 in bond funds have been budgeted and approved for this project. The
additional $175,000 would be requested from the Redevelopment Property Tax Trust Fund for the January - June
2013 period through a separate action by the Successor Agency and subject to approval by the Successor Agency's
Oversight Board and the state Department of Finance. The Second Amendment does not go into effect until these
approvals have been obtained.

BACKGROUND: (CONT'D)
into a Public Improvements Agreement for the Rodeo Marina Sewer Expansion Project (Public Improvements
Agreement), which is attached as Exhibit A. This agreement authorized funding for the design and construction
of sanitary sewer improvements to the Rodeo Marina/Waterfront. These public improvements are expected to lead to
the renovation and expansion of the Marina, thereby stimulating and expanding the existing uses at the waterfront,
including re-opening of the commercial restaurant located at the site.
On May 15, 2012, the Board of Supervisors, acting as the Successor Agency to the Dissolved RDA, approved the
first amendment to the Public Improvements Agreement, which is attached as Exhibit B. This amendment provided
the Rodeo Sanitary District with the necessary funds to complete design and construction of the sanitary sewer line.
The first amendment increased the project scope to include engineering services during construction, Bay
Conservation and Development Commission permits, manhole relocations, easement acquisition, construction
management, enhanced shoring for open cuts, Local Agency Formation Commission review, and sewer connection
fees.
On November 1, 2012, the Successor Agency received a request from the Rodeo Sanitary District for a second
amendment to the Public Improvements Agreement. A copy of that request is attached as Exhibit C. A second
amendment to the Public Improvements Agreement will cover increased design and construction costs resulting from
the discovery of bedrock conditions while extending the sewer line. This amendment also extends the contract
termination date to December 31, 2013. A copy of this second amendment is attached as Exhibit D.
CONSEQUENCE OF NEGATIVE ACTION:
If the second amendment to the Public Improvements Agreement is not approved, the construction project will not be
completed. Blighted conditions at the waterfront will remain and an existing health and safety condition associated
with inadequate sanitary sewer facilities will continue.
