H TO: BOARD OF SUPERVISORS FROM: COUNTY ADMINISTRATOR DATE: SEPTEMBER 30, 1986 SUBJECT: STATUS OF SOLID WASTE ACTIVITY IN THE COUNTY Specific Request(s) or Recommendation(s) & Background & Justification RECOMMENDED ACTION 1. ACCEPT the status reports of the County Administrator and the Community Development Department. 2. DIRECT staff to meet with Mayors Conference to determine if there is a desire to amend the Solid Waste Management Plan with respect to public ownership of sanitary landfills. FINANCIAL IMPACT No direct or immediate impact. Solid waste planning is financed by a surcharge on landfill tipping fee. Public entry into sanitary landfill ownership would require development of a new financial program. REASONS FOR RECONP ENDATION/BACKGROUND The September 1.7 , 1986 memo to the Board of Supervisors from the Director of Community Development "Status Report on Three Privately-Proposed Land- fill Applications" ; the status of the Acme Corps of Engineers permit including legal actions, contingency disposal plans, and BCDC Bay Plan revision; the activities of Delta Diablo Sanitation District, as verbally summarized by the County Administrator and Community Development Department staff were heard by the Board. It was noted that the Solid Waste Management Plan, as supported by the Board, recognized that the sanitary waste industry had been afforded first opportunity to provide new sanitary landfill site( s) , and that the activi- ties of various public entities suggested and implied an interest in entering the landfill site business. Additionally, the Board was aware that revision of the Solid Waste Manage- ment Plan had been ordered by the California Waste Management Board. Accordingly, the Board felt that the Mayors Conference would be an appro- priate body to obtain an early informal expression of the cities ' thinking on this question of public or private ownership and operation of sanitary landfill( s) . Bragdon, Director, Communi De op nt SUBJECT: STATUREPORT ON THREE PRIVATELY-P S S, E LANDFILL APPLICATIONS This memo is to. provide a status report on the three privately-proposed sanitary landfill applications now being considered by the County Planning Commission. This report was requested by the Board at the September 9, 1986 meeting. County Planning Commission Process The County Planning Commission is responsible for certification of the Environmental Impact Reports for the three applications, and acting on the land use entitlements for the projects. All three applications require a land use permit and a General Plan Amendment. The Kirker Pass and Cental Landfill applications also require rezoning and cancellation of Agricultural Preserve Contracts. These entitlements must also be acted upon by the Board of Supervisors if approved by the County Planning Commission. If the entitlements are denied by the County Planning Commission, they are appealable to the Board of Supervisors. The County Planning Commission may act upon all three applications concurrently. The Kirker Pass Waste Management Landfill EIR has been certified. A hearing on the land use entitlements was held and continued to Septem- ber 30. The Central Landfill EIR is awaiting certification. The response .document has been circulated and it is expected that the County Planning Commission will act on the certification at their September 23 meeting. A hearing was held on the land use entitlements and was continued to September 23 , 1986. The East Contra Costa Sanitary Landfill EIR is in the process of being completed. The comment period has closed and the response document is awaiting completion. The County is discussing with the applicant additional funding for completion of the response document. Once additional funding is received, a contract amendment for the EIR consultant can be negotiated and the response document can be complet- ed. A public hearing on the land use entitlements has been held and will be continued until more progress is made on the response document for the EIR. Solid Waste Commission Process Each of the three proposed applications will require an amendment to the County Solid .Waste Management Plan. This amendment must be STATUS REPORT ON THREE PRIVATELY- -2- Sept. 16, 1986 PROPOSED LANDFILL APPLICATIONS approved by the Board of Supervisors, a majority of the cities con- taining a majority of the incorporated population, and the California Waste Management Board. The Kirker Pass Landfill has requested a Solid Waste Plan Amendment. The Board of Supervisors referred this request to the Solid Waste Commission for recommendation. The other two applications have not yet submitted amendment applications, but are expected to do so shortly. In preparation for amending the County Solid Waste Management Plan for the three landfill sites, the Solid Waste Commission has been actively preparing solid waste policies to guide County decision-making on landfills and other solid waste matters. A joint study session between the Solid Waste Commission and the County Planning Commission was held on September 9, and another meeting is scheduled for October 15. The Solid Waste Commission is expected to act concurrently with the County Planning Commission in its recommendation to the Board on a County Solid Waste Management Plan Amendment for all three sites. Future Actions The Community Development Department does not have a recommendation on the three applications at this time. Since there have been many questions raised about proposed mitigation measures and conditions for the land use permit, staff is compiling a preliminary draft of condi- tions for each project for study and discussion with the Planning Commission and Solid Waste Commission at their October 15 Joint Work- shop. By releasing these preliminary draft conditions, there will be a clear understanding that such an action constitutes neither support nor opposition by the Community Development Department. Usually, conditions of approval are not issued until a decision has been made to recommend approval of the project. Most of the conditions will be mitigation measures from the EIRs for the three sites and the policy statements adopted by the Board of Supervisors upon recommendation of the Solid Waste Commission. The conditions of approval will address a wide variety of mitigation measures and operational constraints. For example, categories of conditions are expected to include: Administration Air Quality Biotic Resources Cultural Resources Economics Groundwater Protection Landfill Gas Land Use Litter Noise Public Services & Utilities Safety & Public Health Security Stability & Seismic Surface Water Protection Traffic/Transportation STATUS REPORT ON THREE PRIVATELY- -3- Sept.16, 1986 PROPOSED LANDFILL APPLICATIONS Vectors Visual Quality The above categories are meant to be illustrative and not necessarily exclusive. - If a recommendation for approval is made by the Community Development Department, the conditions of approval would ensure that any landfill . will be constructed and operated with the highest environmental protections. One of the major mitigation measures which has already been approved by the Board of Supervisors as a solid waste policy statement is the requirement for transfer stations. Transfer stations will drastically reduce traffic impacts of all landfills. It is also important to remember that the landfills will also require permits from the Regional Water Quality Control Board and the Bay Area Air Quality Management District which have strict regulations protecting air and water quality. Staff will be in attendance at the Board meeting to answer any other questions that the Board may have.
