HomeMy WebLinkAboutMINUTES - 12042012 - C.71RECOMMENDATION(S): AUTHORIZE the Director of Conservation & Development, or designee, to negotiate terms of a franchise agreement extension with Allied Waste Services of Contra Costa County for solid waste and recycling collection in the unincorporated areas presently served through this agreement, and present for consideration by the Board of Supervisors in 2013. FISCAL IMPACT: The department's cost to negotiate potential terms for an amendment to the franchise would be funded with solid waste collection franchise fees and will not impact the County General Fund. BACKGROUND: Allied Waste Services of Contra Costa County (AWS), a Republic Services company previously known as Pleasant Hill Bayshore Disposal, has a franchise agreement with the County for solid waste and recycling collection which expires in 2015. AWS provides refuse, recycling and green-waste collection services for commercial and residential accounts in the County designated service area. The other large 20-year County franchise agreement, covering most of unincorporated West County, has a term ending in 2013 (Richmond Sanitary Service). That franchise agreement includes an option to extend for 10 years. On January 25, 2011, the Board of Supervisors directed the Conservation & Development Department to request direction from the Board regarding each County solid waste and recycling collection agreement three years before the applicable agreement expires. Staff is requesting authorization to negotiate with AWS to identify possible terms for a franchise agreement amendment, including the duration of any extension that would potentially be proposed, for consideration by the Board of Supervisors in 2013. If the Board of Supervisors prefers that an alternate collection company be identified to begin providing these franchised collection services when the current agreement ends on July 31, 2015, DCD staff will need to begin initial phase of the formal bid process immediately, otherwise, this process would not be concluded until after the expiration of this agreement. CONSEQUENCE OF NEGATIVE ACTION: The County would need to dedicate resources to identifying and negotiating with an alternate service provider, presumably involving a formal bid process, for the area being served under the Allied Waste Services franchise.
