HomeMy WebLinkAboutMINUTES - 11132012 - C.29RECOMMENDATION(S): APPROVE a First Amendment to Lease with Seecon Financial & Construction Co., Inc., for a 5-year term beginning February 1, 2013, and ending January 31, 2018, for approximately 14,900 square feet of office and classroom space located at 4071 Port Chicago Highway, Suite 250, Concord, at a rental of $25,700 per month, for continued occupancy by the Employment and Human Services Department – Workforce Development Board, and APPROVE an Amendment to Sublease with the State of California – Employment Development Department for approximately 6,600 square feet in those premises, at a rental to the County of $13,110 per month, under the terms and conditions set forth in the First Amendment to Lease and the Amendment to Sublease. (WLP755) AUTHORIZE the Public Works Director, or designee, to EXECUTE the First Amendment to Lease and the Amendment to Sublease on behalf of the County, and to EXECUTE any options to extend the Lease or the Sublease. Bueren, Public Works Date:November 13, 2012 Contra Costa County Subject:4071 Port Chicago Highway, Suite 250, Concord - First Amendment to Lease and Amendment to Sublease, for Employment and Human Services Department FISCAL IMPACT: (CONT'D) to Lease will obligate the County to pay rent of $1,546,800 over the five (5) year Lease term. The new rent represents a decrease from previous rents in the amount of $57,180 per year, for annual savings of approximately 16%. Through a separate subleasing agreement with the State of California - Employment Development Department (EDD), EDD will sublease approximately 6,600 square feet of the Premises and will pay the County $786,600 over the five (5) year term. Therefore, the net cost to the County for this lease extension will be $760,200 over the term. Eighty percent (80%) of the net cost will be offset by Federal and State cost reimbursement, and the remaining twenty percent (20%) will be paid from the General Fund. The leased premises are in need of minor improvements that are estimated to cost approximately $150,000. To offset those costs, the Lessor will pay $105,000 of the improvement cost, and the County will pay the remaining cost of approximately $45,000. Separately, the Lessor will abate $77,340 of the County’s rent during the first three (3) months of the new term. The First Amendment to Lease was anticipated and budgeted in the Employment and Human Services Department approved Fiscal Year 2012/2013 budget. (Funding source: Org. #5450.) BACKGROUND: The Employment and Human Services Department – Workforce Development Board has partnered with the State of California’s Employment Development Department in occupying this leased space since February 2005, with both parties providing employment service programs to the general public. This partnership has improved the ability of both organizations to provide essential employment services to the residents and employers of Contra Costa County. The First Amendment to Lease and the Amendment to Sublease will allow the County and State to provide continued employment service programs to the public at this location. CONSEQUENCE OF NEGATIVE ACTION: The First Amendment to Lease and the Amendment to Sublease will not be executed, the County will not have possession of the premises to sublease to the State, and the County will then have to identify other premises in which to locate, likely at a greater expense to the County.
