SUBJECT: APPROVING FIRST AMENDMENT TO AGREEMENT FOR ARCHITECTURAL SERVICES
FOR WEST COUNTY JUSTICE CENTER, RICHMOND (4411-4101; 0928-WH101B)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
APPROVE the First Amendment to the Architectural Services Agreement with Dworsky/Design
Partnership, a Joint Venture, and AUTHORIZE the County Administrator or his designee to
execute the Amendment which will (1) revise the Fixed Limit of Initial Construction
Contract Cost to $331152,220, (2) modify a portion of the design fee to 8.67 percent of the
Fixed Limit of Initial Construction Contract Cost required to construct the off-site
improvements including road and utility realignment and upgrading, and (3) reimburse the
Joint Venture for any increased premiums. for Professional Liability Insurance resulting
from expanded design services for providing off-site design services.
FINANCIAL IMPACT:'
This Amendment, in part will reduce the fees paid to the Architect. The reduction of the
estimated Construction Contract Cost from $37,918,042 to $33,152,220 reduces the
Architect's fee for the Schematic Design and Design Development phases by $95,077. This
reduction will be partially offset by another part of this Amendment; which has the
potential to increase the encumbrance for basic Architectural Services by a maximum of
$40,400 (from a projected total architectural fee of.. $',204,623 to $2.245,023) and increase
the reimbursable limit for Professional Liability Lnsurance from I'l_'10,470 to $211,500. The
$40,400 increase for Architectural Services is based on the assumption that off-site
construction costs shall not exceed $2,000,000 of the $33,152,220 construction budget. If
this- work has a lower construction estimate, the financial impact will be proportionately
less
REASONS FOR RECOMMENDATION/BACKGROUND:
A. On December . 17, 1985, the Board approved and the County executed an Architectural
Services Agreement . with Dworsky/Design Partnership for two phases of architectural
service: Schematic Design and Design Development. The contract also established a
total full service fee of 6.65 percent of the Fixed Limit of Initial Construction
Contract Cost based on the limit to be established in the -Predesign Program (the
contract estimated an Initial' Construction Contract Cost .of $37,918,042, which is
now being revised 'to $33,152,220 based on the Board of Supervisors' July 8, 1986
approval of the Predesign Program). The percentage fee becomes effective when the
contract is amended to include full services upon completion of the Design Development
Phase. In addition, the contract provides for the reimbursement of premiums for
Professional Liability Insurance up to a total $210,470.

The Architectural Services Agreement was negotiated between April and December 1985,
before the decision was made to relocate Atlas Road and Giant Highway and the
utilities that parallel these two roads. Although limited off-site work was
anticipated, the extent 'of this specialty civil engineering service was not
anticipated nor considered during contract negotiation. The Architect has selected a
local engineering firm' with experience in off-site road and utility design. This
amendment adjusts the Architect's fee to provide for these extra services. The
selection of a local firm with experience in this type of engineering design work, as
well as familiarity in city and utility company requirements and standards, should
.expedite this phase of the project and has the potential to decrease the County's cost
for .off-site construction.. In addition, the insurance underwriter, in calculating
premiums for Professional Liability Insurance, did not initially include coverage for
off'-site design services.
B. The project is currently in the Schematic Phase of Design. In order for the project
to proceed. without delay or 'discontinuity of service, it is necessary to amend the
Agreement for Architectural Services to provide for these expanded services to be
provided by a civil engineering firm with off-site engineering expertise and knowledge
of the northern Richmond area. Approval of this Amendment will modify the Agreement
to require the Architect to provide professional services for this expanded scope of
work. This amendment does not affect the extent of these services which remain
limited to the Schematic Design and Design Development Phases; a separate contract
amendment will required to authorize the Contract Documents Phase.
