ADOPT Resolution No. 2012/477 which increases the size of the Housing Authority of the County of Contra Costa's
Board of Commissioners from six members to seven as mandated by California Health and Safety Code Section
34290 and as requested by the Housing Authority's Executive Director.
FISCAL IMPACT:
No impact on the General Fund.
BACKGROUND:
On March 15, 2011 the Board of Supervisors adopted Ordinance No. 2011-01, which dissolved the Advisory
Housing Commission for the Housing Authority of the County of Contra Costa (HACCC). In order to comply with
the State's Health and Safety Code, the number of members on HACCC's Board of Commissioners must now be
increased from six to seven.
Section 34290 of the Health and Safety Code provides that a housing authority's Board of Commissioners shall
include two tenants, one of whom must be over 62 years of age. If the housing authority has an advisory housing
commission, then the two required tenant commissioners may be appointed to that body instead of the Board of
Commissioners. HACCC has utilized

this option in the past and appointed the two required tenant commissioners to the advisory housing commission.
On November 16, 1999, in response to federal requirements, HACCC's Board of Commissioners was expanded to
include one tenant in addition to the five members of the Board of Supervisors. Now that the Advisory Housing
Commission has been dissolved, the number of tenants on HACCC's Board of Commissioners must be increased
from one to two which will in turn increase the total number of commissioners from six to seven. The attached
resolution, Resolution No. 2012/477 enables this increase.

RESOLUTION INCREASING THE CONTRA CONTRA COUNTY HOUSING AUTHORITY
BOARD FROM SIX TO SEVEN MEMBERS
WHEREAS, California Health & Safety Code Section 34120(b) states that if the legislative body of the county has declared
itself to be the housing authority commission, the legislative body shall appoint two additional commissioners who are tenants of
the housing authority;
WHEREAS, an advisory housing commission was created on November 24, 1981 and housing authority tenant appointments
were made to the advisory housing commission rather than the housing authority commission pursuant to Health & Safety Code
Sections 34120(c) and 34120.5;
WHEREAS, the advisory housing commission was dissolved on March 15, 2011; and
WHEREAS, the Housing Authority Board of Commissioners must have two tenant commissioner seats since the advisory
housing commission has been dissolved.
NOW, THEREFORE, BE IT RESOLVED that the Contra Costa County Housing Authority Board of Commissioners
is increased from six (6) to seven (7) members, by adding one (1) additional Tenant seat.
