HomeMy WebLinkAboutMINUTES - 11062012 - C.74RECOMMENDATION(S): APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to terminate the Copyright License Agreement, dated August 2009, between the County and Hunter Research, Inc., and Starfire Development Inc., for the ARIES Data Integration and Development Suite, PC-Dek Module, “Fargo” middleware, and any derivative products. FISCAL IMPACT: None. BACKGROUND: In 2003, Contra Costa County retained the services of Hunter Research, Inc., and Starfire Development Inc., to create, develop, enhance, improve and maintain the Automated Regional Information Exchange System Data Integration Suite (ARIES), PC-Dek Module, and Fargo middleware. In 2007, Hunter Research, Inc., and Starfire Development Inc., registered ARIES with the United States Copyright Office. The Office of the Sheriff negotiated with Hunter Research, Inc. and Starfire Development Inc., to assign their rights, title and interest in ARIES to Contra Costa County. In return, the County licensed ARIES, PC-Dek Module, and Fargo middleware, and any derivative products to Hunter Research, Inc. and Starfire Development Inc. Livingston, Office of the Sheriff Date:November 6, 2012 Contra Costa County Subject:Termination of Copyright License Agreement BACKGROUND: (CONT'D) 10, 2009, the Board of Supervisors ratified the execution of a Copyright License Agreement, with Hunter Research, Inc., and Starfire Development Inc., for the ARIES Data Integration and Development Suite, PC-Dek Module, “Fargo” middleware, and derivative products. The contract between Contra Costa County and Hunter Research, Inc., expired on December 31, 2011. Hunter Research, Inc., has no further relationship with the County or the ARIES System. Approval by the Board of Supervisors will allow the Office of the Sheriff to issue a thirty (30) day advance written notice to the Licensee (Hunter Research, Inc.), in accordance with the Copyright License Agreement, Section 9.2(c) Termination by Licensor (County of Contra Costa), that the Copyright License Agreement is terminated effective close of business on December 5, 2012.
