("Enovity") for the Remodeling of 30 and 40 Muir Road project, Martinez, for the Department of Conservation and Development ("DCD"), for a revised total agreement amount of $101,630. 2. AUTHORIZE the Public Works Director, or designee, to execute the Amendment. FISCAL IMPACT: Funding is provided by a DCD fund comprised of Land Development fees collected for facility improvements and operations. BACKGROUND: On November 1, 2010, the County entered into a Consulting Services Agreement with Enovity for Enovity to provide commissioning agent services for the 30 Muir Road Remodeling project. These services are required for Leadership in Energy and Environmental Design ("LEED") certification. Bueren, Public Works Date:November 6, 2012 Contra Costa County Subject:APPROVE Amendment No. 2 to Consulting Services Agreement with Enovity, Inc. for the Remodeling of 30 and 40 Muir Road Project, Martinez BACKGROUND: (CONT'D) During construction, DCD determined that it required approximately 5,000 square feet of additional office space. The adjacent County-owned building at 40 Muir Road is currently vacant, and therefore can accommodate DCD's additional space needs. On October 23, 2012, the Board approved a change order to the design-build construction contract with Vila Construction Company, Inc., authorizing the interior remodeling of approximately 5,000 square feet of the ground floor of 40 Muir Road for DCD. Amendment No. 2 to Enovity's agreement would add to Enovity’s scope of services commissioning agent services for the additional 5,000 square feet of remodeling at 40 Muir Road. The Public Works Director recommends the approval of Amendment No. 2 in the amount of $21,780, for a revised total agreement amount of $101,630, to enable the remodeling at 40 Muir Road to also qualify for LEED certification. CONSEQUENCE OF NEGATIVE ACTION: If Amendment No. 2 is not approved, the additional remodeling at 40 Muir Road would not be able to qualify for LEED certification. CHILDREN'S IMPACT STATEMENT: Not applicable.
