INTRODUCE Ordinance No. 2012-04, amending the County Better Government Ordinance to require the online
posting of agenda materials and certain communications to a quorum of the Board of Supervisors, and to establish
procedures for reporting final litigation settlement agreements to the public and WAIVE reading.
FISCAL IMPACT:
Total fiscal impact unknown. The County will be required to purchase a new governmental transparency solution to
implement the BGO amendment in addition to achieving other goals within the Clerk of the Board's Office. The
three-year cost associated with that solution is $307,616 and is under consideration on today's agenda.
BACKGROUND:
On May 17, 2011, the Board of Supervisors referred to the Internal Operations Committee a proposed amendment to
the Better Government Ordinance. The Committee was asked to evaluate whether the Better Government Ordinance
should be amended to specify new procedures for reporting litigation settlements, as recommended by County
Counsel, and to require: (1) that all County-staffed policy bodies post their agenda packets online; (2) that
communications to a quorum of the

Procedures For Public Reporting of Settlements
BACKGROUND: (CONT'D)
Board of Supervisors be posted on the Contra Costa County internet web site; and (3) that communications to a
quorum of other County-staffed policy bodies be posted on their internet web sites and linked to the County web
site.
The Internal Operations Committee discussed this matter on July 11, October 5, and November 21, 2011. It was
determined that the Better Government Ordinance should be amended to include the County Counsel’s
recommended procedures for reporting litigation settlements and should also be amended to require: (1) that all
County-staffed policy bodies post their agenda packets online; (2) that certain communications that are authorized
by a Department Head to be sent to a quorum of the Board of Supervisors or a committee of the Board of
Supervisors be posted on the Contra Costa County internet web site for a period of 120 days; and (3) that
communications to a quorum of other County-staffed policy bodies be placed in a public viewing file for a
minimum of 30 days, as is currently required.
If the Board approves the amended ordinance, the County Administrator will have a copy of this Board Order and
the amended ordinance sent to all policy bodies and all Department Heads advising them of the requirements of
the amended ordinance.
The recommended action before the Board today is the introduction of Ordinance No. 2012-04. It is being
considered along with a proposed contract with Granicus, Inc., for the purchase of an online record management
system. If the Board accepts staff’s recommendations today to introduce the ordinance and to enter into an
agreement with Granicus, Inc., the ordinance will be placed on a future agenda for adoption after the online record
management system has been implemented.
CONSEQUENCE OF NEGATIVE ACTION:
If the Better Government Ordinance is not amended to provide for greater online access to agenda packets and/or
communications to the Board of Supervisors, this information will be less available than it would be under the
amended procedure. Public reports of litigation settlements will continue to be made in the manner described
above even if the ordinance is not amended. However, amending the ordinance will provide additional assurance
that final settlements are reported to the public expeditiously and on a regular basis.

County Ordinance Code Section 25‐2.202 states that a "policy body" means the Board of Supervisors, or any
permanent or temporary board, committee or commission under the authority of the board of supervisors.
Policy bodies do not include committees entirely made up of county staff. The attached list includes the
policy bodies identified by the County Administrator’s Office to exist as of November 14, 2011. All
subcommittees of policy bodies have not been independently listed, but it should be noted that
subcommittees of policy bodies are also considered to be policy bodies and subject to the Better Government
Ordinance.
