HomeMy WebLinkAboutMINUTES - 10162012 - C.20RECOMMENDATION(S): RECEIVE public report of litigation settlement agreements that became final during the period of September 1, 2012 through September 30, 2012, as recommended by County Counsel. FISCAL IMPACT: Settlement amounts are listed below. BACKGROUND: One agreement to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of September 1, 2012 through September 30, 2012. C&H Sugar v. Crockett Community Services District, Contra Costa County, CCC Sup. Ct Case No. N07-1747. The case concerns claims by C&H Sugar Company, Inc. (C&H) that the Crockett Community Services District (District) charged it fees in violation of the law. Pursuant to the settlement agreement, C&H will dismiss its lawsuit against the District and the County. The settlement agreement does not obligate the County to adjust previous tax bills. Additionally, the County has no obligation under the settlement to pay C&H. This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report does not include litigation settlements that were reported by the Risk Management Division of the County Administrator’s Office as a consent item on the Board’s open session agenda. CONSEQUENCE OF NEGATIVE ACTION: The report would not be accepted. CHILDREN'S IMPACT STATEMENT: Not applicable.
