("Cleary Bros.") for the Iron Horse Corridor Landscaping at Walden Green, Phase 2, between Mayhew Way and Coggins Drive, Pleasant Hill, for the Department of Conservation and Development. 2. AUTHORIZE the Public Works Director, or designee, to execute the Change Order which provides for additional work and increases the pay limit by $52,585 for a total contract amount of $588,604. FISCAL IMPACT: Funding is provided by Redevelopment Reserves. BACKGROUND: The adoption of the Contra Costa Centre Area Specific Plan by the Board of Supervisors in October 1998 provided for the conversion of the Iron Horse Corridor (the former Southern Pacific right-of-way) to a linear green between Treat Boulevard and Mayhew Road to the north. Landscape for the Landscaping at Walden Green Phase 2, Pleasant Hill, Project BACKGROUND: (CONT'D) In 2005, construction was completed on the first phase of the linear greenway ("Walden Green Phase 1"), between Treat Boulevard and Coggins Drive. On January 24, 2012, the Board of Supervisors awarded a construction contract in the amount of $536,019 to Cleary Bros. for the Walden Green Phase 2 Project, which extends the linear greenway from Coggins Drive to Mayhew Way, a length of approximately 1/4 mile. Subsequent to award of the construction contract, and before construction began, arsenic-contaminated soil was discovered on the site. Public Works hired Engeo Inc. ("Engeo") to survey the site and determine the extent of the contamination. Based on their findings, Engeo prepared a report on procedures to be followed by Cleary Bros. in performing the construction work. The report was reviewed and approved by the County Health Services Department's Hazardous Materials Program. This change order in the amount of $52,585 includes the additional work that Cleary Bros. must perform to comply with proper procedures in handling the contaminated soil and to add landscaped mounds that will allow for on-site use of the contaminated soil. The change order is authorized by Public Contract Code Section 20137. The Public Works Director recommends that the Board approve Change Order No. 1 in the amount of $52,585 and authorize the Public Works Director, or designee, to sign it for the County. CONSEQUENCE OF NEGATIVE ACTION: The Walden Green Phase 2 project would not be able to proceed without this change order, because it is not possible to perform the contract work without disturbing the arsenic-contaminated soil.
