APPROVE the Marsh Creek Reservoir Grazing Agreement Project and make related findings under the California
Environmental Quality Act (CEQA) [DCD-CP#12-37], Brentwood area. (District III) Project No.: 7521-6D8329.
FIND the project is a California Environmental Quality Act (CEQA), Article 5, pursuant to Section 15061 (b) (3), of
the CEQA Guidelines, and
DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk, and
AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Department of Conservation and
Development for processing, and a $50 fee to the County Clerk for filing the Notice of Exemption.
FISCAL IMPACT:
The estimated cost to enter the Grazing Agreement is $6,000, to be funded 100% by Flood Control Zone 1 funds.

BACKGROUND:
The project consists of the Flood Control District (District) preparing an agreement to allow the grazing of
livestock as the primary tool to manage vegetation on approximately 218 acres surrounding the Marsh Creek
Reservoir (APN’s: 007380-019 and 007-380-020). These properties serve as overflow areas for Marsh Creek
Reservoir; excess storm runoff from the reservoir is stored on these lands. These properties were acquired from
the Trust for Public Lands in the early 2000’s and their use is subject to restricted covenants which require the
land to be managed as a wildlife preserve, scenic view-shed and public recreation area. Weed abatement via
grazing is consistent with the management covenants. Historically these lands have been allowed to be utilized as
grazing lands for cattle for weed abatement. The District intends to formalize this current activity via an
agreement with a grazing company.
CONSEQUENCE OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of executing the agreement and may jeopardize the timely
weed abatement at the site.
