IT ISBY THE BOARD ORDERED that the County Administrator and
Health Services Director are AUTHORIZED to sign on behalf of the
County a holed harmless agreement with the University of California-
Lawrence Berkeley Laboratory to conduct air sampling for volatile
organic compounds for the purpose of research in connection with
the recent toxic air incident at the Wells Fargo Building in
Concord.

Dear Mr. Bergman:
I 'm writing in response to your request yesterday on behalf of
the Director of the Health Services Department, Contra Costa
County, that Lawrence Berkeley Laboratory' s Indoor Air Quality
Group conduct air sampling for volatile organic compounds for
the purpise of research in the Wells Fargo Building in Concord.
If, after talking with you and visually inspecting the
building,1 we determine that air sampling in the building
represents an opportunity consistent with the programmatic
needs of our research for the U. S. Department of Energy, then
we would conduct limited air sampling for volatile organic
compounds at a mutually agreed upon indoor location and at an
outdoor Vocation near the building .
We intend to report to you, after our internal review, a
listing olf volatile organic compounds observed and their
concentrations along with a brief description of the sampling
and analytical techniques employed.
In consideration of the foregoing, the County of Contra Costa,
by and through its Department of Health Services , and Wells
Fargo Bank grant permission to the University of California,
Lawrence Berkeley Laboratory to enter the premises located at
1220 Concord Avenue, Concord, California and to conduct the
scientific studies outlined above and agree to protect, defend,
indemnify;, and hold harmless the U.S. Department of Energy
and/or the University of California, their officers, Regents,
employees, and agents against and from any and all liability,
or any suit or claim therefor, by reason of actual or alleged
property damage or personal injury or death, arising out of or
in connection with the performance of work outlined herein.
It is understood that Lawrence Berkeley Laboratory makes no
warranty, lexpress or implied, that any information provided the
County and/or Wells Fargo Bank or developed by the research is
accurate or complete.

Lawrence Berkeley Laboratory personnel will exercise reasonable
care not to cause injury or damage to persons or property and
not to interfere with Wells Fargo ' s use of the premises except
as necessary to accomplish its studies .
If the foregoing is acceptable to you, will you please sign the
enclosed copy of this letter, have it signed by an authorized
representative of Wells Fargo Bank and return the copy to me.
