DATE: January 28, 1986 Wu* SUBJECT: Byron Union School District Request Re: School Facility Dedication Ordinance SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION RECOMMENDATION.: 1 ) Apprive the request of the Byron Union School District by approving this Order and adopting the attached resolution. 2) Approve the division of fees at 46% for Liberty Union High School Dis- trictl and 54% for the Byron Union School District. FINANCIAL IMPACT: None. BACKGROUND: In 1978, the Board of Supervisors concurred with the findings (School Board Resolution 78-4 and Application for Financing Interim School Facilities) from the Byron Union School District which established that a condition of overcrowding was in existence. In 1982, Byron Union School District's participation in this program was dis- continued at their request. Recently, by letter of December 11 , 1985, the Byron Union School District requested that the Board of Supervisors concur that the School District be allowed to again participate in the County's School Facility Dedication Ordinance program. Reasons for their request are stated in their letter which is attached. In approving the School District's request, the Byron Union School District would then share the fees with the Liberty Union High School District inasmuch as the Byron .Union School District is located within the Liberty High School District. The Liberty Union High School District is already participating in this program. The two school districts have agreed to a division of fees that provides that 46% of the fees would be given to Liberty Union High School District and 54% would go to the Byron Union School District. A public hearing before the Board of Superviso to consid r the Byron Union School District's request is scheduled for Feb uary 4th a 10:30 a.m. This report is being submitted for the Board's cons er n this hearing. Board its findings that conditions of overcrowding exists in an attendance area within the District. The notice of findings from the School District also sets forth the information, required by 0812-6.202 and 812-6.204 of the County's School Facility Dedication Ordinance. The precise boundary of the proposed overcrowded attendance area, which will hereinafter be called "Attendance Area No. 4" , is all of the territory contained within the Byron Union School District: This Board has reviewed and considered the Byron Un.ion School District's notice of- findings and the information set forth therein and all the information provided it at the hearing conducted to consider whether it should concur with the School District's findings,. This Board hereby determines that it concurs with the said Byron UnioniSchool District's notice of findings and re-establishes Attendance Area No. 4 for the Byron Union School District's area. In connection with this determination, this Board makes the following findings: 1 . That the County's School Facility Dedication Ordinance No. 78-10 is an ordinance adopted pursuant to §65974 of Chapter 4.7 of the Government Code. 2. That the location and amount of land to be dedicated or the amount of fees to be paid,. or both, in Attendance Area No. 4 will .bear a. reasonable relationship and �will be limited to the needs of .the community for interim ele- mentary and highlschool facilities and will be reasonably related and limited to the need for schools caused by development in Attendance Area No. 4. 3. That the County's General Plan provides. for the location of public schools. Any interim school facilities to be constructed .from fees or lands to be required to be dedicated, or both, will be consistent with the .General Plan. 4. The land or fees , or both, transferred to the Byron Union School District will be used only for the purpose of providing interim elementary or, high school classroom and related facilities. The Clerk of this Board. is directed to notify the Byron Union School Dis- trict of this Board's concurrence and the re-establishment of Attendance Area No. 4. Finally, the Clerk shall provide notice of the re-establishment of this Attendance Area by sending copies of this Resolution to the County's Building Inspection , Planning and Public Works Departments.
