ADOPT Resolution No. 2012/356 approving the Final Map for Subdivision SD12-09322 (cross reference
DP12-03009 and SD04-08828), a project being developed by Hofmann Land Development Company, as
recommended by the Public Works Director, Discovery Bay area. (District III)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The developer has not constructed housing on the lots approved by this Board with Subdivision 04-08828 because of
economic conditions. All of the improvements required under SD04-08828 have been constructed. In preparation for
housing to be constructed, the developer has adjusted lot lines and reconfigured lot shapes to satisfy current market
conditions as approved by Development Plan DP12-03009. Because there are more than four lot line adjustments, a
new final map is required by the Subdivision Map Act, Section 66412(d), creating the need for a new final map. The
number of lots remains the same, and there are no new conditions of approval to satisfy.

CONSEQUENCE OF NEGATIVE ACTION:
If this new final map is not approved, the developer will be required to construct housing as initially approved by
Final Map 04-08828. This will deny the developer to produce homes that meet current market expectations.
