FIND the project is a California Environmental Quality Act (CEQA), Class 1c Categorical Exemption, pursuant to
Article 19, Section 15301(c) of the CEQA Guidelines, and
DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk, and
AUTHORIZE the Public Works Director to arrange for payment of $25 fee to Conservation and Development for
processing, and a $50 fee to the County Clerk for filing the Notice of Exemption.

FISCAL IMPACT:
This project is funded with Transportation for Livable Communities 55%, Prop 1B 30%, and Local Road funds
15%.
BACKGROUND:
The purpose of this project is to reconstruct and adjust sidewalk features along an existing section of San Pablo
Dam Road within the County right of way to provide an unobstructed path of travel that is compliant with the
Americans with Disabilities Act (ADA). The project consists of the reconstruction or redesign of existing
concrete sidewalk, curb ramps and gutters along an approximately 2,700 foot section of San Pablo Dam Road,
between Appian Way and El Portal Drive, compliant with ADA standards. The project will include drainage
improvements and utility adjustments. The project will also construct potted landscaping, improve existing
signage, and relocate bus stop signage. The project may remove approximately five bus stop benches that obstruct
ADA and pedestrian traffic. Some illegal parking areas have encroached into the County’s sidewalk right of way
obstructing pedestrian traffic, so they will be adjusted to increase sidewalk accessibility. These improvements to
the County’s sidewalk right of way will create more accessibility for pedestrian traffic and members of the
community that require ADA compliant sidewalks. The project will require temporary construction easements for
selected driveways. It may be necessary to remove 40 urban landscape trees (i.e. street trees) to accommodate the
improvements; however the project also includes landscaping with street trees. In order to minimize damage to
any nearby trees that will not be removed, any roots exposed during excavation will be cut cleanly. In addition,
tree branches and shrubbery may need to be trimmed throughout the project. To ensure compliance with the
Migratory Bird Treaty Act (MBTA), trees will be removed outside the nesting season (February 15th to August
31st), or a preconstruction nesting survey will be conducted. Prior to construction, affected property owners will
be notified by the contractor of the upcoming construction activity and access to private property or businesses
will be maintained throughout the project. Emergency vehicles will have access through the project area at all
times. Real property transactions and utility relocation may be necessary in support of this project.
CONSEQUENCE OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design, construction and loss of funding.
