C. 56261. 1, .56386 (c) , Protection Districts ) 56385. ) The Board of Supervisors of Contra Costa County, as the conducting authority for the proceedings to consolidate the Brentwood and Eastern Fire Protection Districts, resolves that: 1. On July 19 , 1985 , Resolution No. 85/419 of the Contra Costa County Board of Supervisors., acting as the Board of Directors of both the Eastern Fire Protection District (EFPD) and the Brentwood Fire Protection District (BFPD) , was filed with the Executive Officer of the Local Agency Formation Commission, requesting that the Eastern and Brentwood Fire Protection .Districts be. combined in order to provide .. more efficient and cost effective fire protection services to the territory of the two Districts by having one new district with one . board of fire commissioners , a single management structure, and one operational area throughout the territory of the two Districts . 2 . On October 16 , 1985, by Resolution LAFC 8.5-19 the Local Agency Formation Commission of Contra Costa County approved the ..proposed consolidation, subject to all terms and conditions proposed in Resolution 85/419 of this Board. Said Resolution. LAFC 85-19 designated this Board as the conducting authority for the proceedings for consolidation, as set forth in Government Code Sections 56380 . et seq. , and authorized this Board to order the consolidation without an election, except - as otherwise provided in subdivision (b) of Government Code Section 56261. 1. 3 . At 10 :30 a.m, on Tuesday, December 17 , 1985, in this Board' s Chambers , County Administration Building, Martinez, California, this Board conducted a public hearing on the proposed annexation, when all interested persons . or taxpayers for or against the proposal were heard, and any protests and objections were received. 5. Insufficient protests having been filed -to require an election, pursuant to Government Code §56261. 1, this Board hereby orders the consolidation without an election and subject to the following, as authorized by the approval of the Local Agency Formation Commission. a. Both Districts were formed and have .been operating under the Fire Protection District LAW of. 1961 (Health & Safety Code §913800 et seq. ) and are subject .to Board of Supervisors Resolution 80%216 . The new consolidated district also istooperate under the Fire Protection District Law of 1961 and Resolution 80/216. b. The exterior boundaries of the Districts to be con- soli,q.ated are as shown in the attaC7-_ec7 "X'-;..bits A(1) and A(2) , which RESOLUTION 86/55 set forth the boundaries of the Eastern Fire Protection District and the Brentwood Fire Protection District, respectively. C. The name of the new fire protection district formed upon the consolidation is to be the East Diablo Fire Protection District of Contra Costa County. d. A condition of the proposed consolidation is to be that all property, other assets, rights, obligations and personnel of the two Districts to be consolidated become the property, other assets, rights, obligations and personnel of the new consolidated District. e. The Board of Supervisors, as the Supervising Authority, shall be the Board of Directors of the new con- solidated District. This Board hereby declares its intent to appoint a Board of Fire Commissioners to manage the affairs of the new consolidated District, pursuant to Health and Safety Code 513884 and Board Resolution No. 80/216 . f. Pursuant to Section 3 (a) of Article XIIIB of the California Constitution, this Board hereby agrees and determines that, when the existence of the present two Districts ceases upon the effective date of the consolidation, the appropriation limits of the two Districts shall be combined and be transferred to become the appropriation limit of the new consolidated District.
