(applicant) and 505 Oak Road Associates (owners) , Pleasant Hill BARTD Station Area. This being the time for hearing on the recommendation of Contra Costa County Planning Commission with respect to the application filed by Jaymont Properties , Inc. and 505 Oak Road Associates (2648-RZ) to rezone 1 . 91 acres fronting on the south side of Las Juntas Way immediately west of the BARTD Station prop- erty and fronting on the east side of the proposed Oak Road Extension and the north side of the proposed Wayne Drive BARTD Station access road from Single Family Residential District (R- 15) to Planned Unit District (P-1 ) in the Pleasant Hill BARTD Station Area; and Harvey Bragdon, Assistant Director of Community Develop- ment, advised that the applicant had simultaneously filed an app- lication for approval of a development plan (3056-85) for an office development and described the property site and advised that no Environmental Impact Report was prepared for this project inasmuch as the area is covered by the Pleasant Hill BARTD Station Area Specific Plan EIR. The Chairman opened the public hearing and no one appeared in opposition. The public hearing was closed. Supervisor McPeak addressed the Transportation Systems Management and child care issues. Mr. Bragdon responded that they were both a part of the conditions of approval for the development plan. Thel Board considered that matter. IT IS BY THE BOARD ORDERED that rezoning application 2648-RZ is APPROVED as recommended by the County Planning Commission and that Develop- ment Plan 30516-85 is also APPROVED subject to conditions imposed by the Planning Commission and the Board of Supervisors as set forth in Exhibit A attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission' s reasons, setlforth in its Resolution Number 6-1986 as its determination s for this decision. IT IS FURTHER ORDERED that Ordinance Number 86-14 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and February 25 , 1986 is set for adoption of same. This application is based upon the following exhibits subject to the following conditions: a) Exhibit A! - Site Plan (DD-1) showing Las Juntas improved; or Exhibit AA -Site Plan (DD-2) showing Las Juntas closed pending final decision on Las Juntas.and plan amendment if necessary. b) Exhibit B i Parking Garage Floor Plan I c) Exhibit C�- Lobby level floor plan d) Exhibit DJ- Intermediate Lobby Floor Plan e) Exhibit EI- Typical Floor Plans i f) Exhibit F! Approval is based on the aforesaid exhibits, and following conditions, however all conditions are subject to further review and approval by the Zoning Administrator. The Pleasant Hill BART Station Specific Plan shall serve as the basis for review and it may be that additional requirements, conditions and/or modifications may be specified following further review. 3. This approvall is limited to a maximum of 101,842 gross square feet and 94,242 net square feet of office. This includes the transfer of a minimum of 9,000 square feet from other sites. Documentation of these transfers shall be submitted and approved as required by the TDR Amendment to the Specific Plan and adopted TDR procedures. 4. Uses allowedi shall include administrative and professional offices. Uses which may conditionally be allowed as listed in the Specific Plan are subject to the applicant submitting detailed information to the Zoning Administrator for review and approval addressing the conditional use criteria in the Specific Plan and any other information as may be requi red. 5. The applicant will comply with the Parking Policies of the Pleasant Hill BART Specific Planus follows: A. The applicant will submit a detailed TSM Plan for review and approval no less than 60 days prior to requesting final inspection of the building or occupancy. The approved plan will be in effect prior to occupancy. Exhibit A i 3056-85 pg. 2 - i i B. This conditI ion may be satisfied by participation in an approved areawide TSM Program which is in'effect prior to occupancy. The applicant will participate in an approved areawide TSM Program when one is established. C. The applicant will monitor parking and submit reports annually to the Zoning Administrator for review. This will include 1) the number of parking spaces used relative to Ithe amount of building occupied at differing times of day and year; 2) number of single occupied vehicles; 3) parking fee structure; and 4) a summary of a questionnaire to all building employees as to their commute practices; and 5) any additional information as may be required by the Zoning Administrator. D. Should they Zoning Administrator, as a result of the annual review, determine that reasons exists to consider the addition, deletion or alteration of conditions of approval relating to the parking program, the matter will be administratively brought back to public hearing. G. The applicant will submit any proposed fee structure and program or pass/card program for Zoning Administrator review and approval. Such programs shall be designed so as to not cause a backup of traffic on the public roads. 6.. The project will comply with the following landscape requirements: A. A final landscape and irrigation plan will be submitted prior to the issuance of a building permit. 'B. Approved landscaping shall be installed prior to occupancy of any portion of any building. C. The landscaping plan shall be consistent with areawide guidelines currently being used and shall provide substantial "urban" pedestrian oriented plaza areas as well as detailed, attention to the elevation to the elevation of the parking structure as it relates to pedestrian areas. 7. The design of!all signs will be as specified in the Pleasant Hill BART Station Plan, relative to location, scale, colors, materials, illumination, size and copy. Sign design will be consistent throughout the project and wit! conform with the Urban Design Guidelines being prepared. 8. The applicant' will comply with the requirements of the Central Contra Costa Sanitary District and the Contra Costa Water District. 9. Comply with the requirements of the Contra Costa Consolidated Fire District. 10. The applicant shall agree and make it a condition of lease agreements that future leaseholders and tenants agree to use a Pleasant Hill address. 11. The applicant ishall agree to participate in addressing area-wide child care issues. 12. The top level of parking shall be covered. Trellising may be acceptable. Final design shall be subject to Zoning Administrator review and approval. Exhibit A i • 3056-85 pg. 3 13. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance, unless exceptions are specifically granted. B. Unless exceptions are specifically granted, comply with the requirements of Division 11006 (Road Dedication and Setbacks) of the County Ordinance Code. This includes the following: I) Priorlto the issuance of any building permits, convey to the Redevelopment Agency by Grant Deed, additional right of way as required for the public road improvements as shown on the plans developed by the Assessment District 1983-1 Engineer and on file with the Public Works Department. 2) Improvements planned for Assessment District 1983-1 will satisfy all other requirements of Division 1006. C. In the event it is determined that Las Juntas will remain open to intersect with Oak Road the applicant will be required to construct curb, gutter and sidewalks along the frontage of Las Juntas Way in accordance with plans developed by the Assessment District 1983-1 Engineer as approved by the Public Works Department. D. Install all new utility distribution services underground. This shall include providing for the undergrounding of Cable television cables. I E. Prevent storm drainage, originating on the property and conveyed in a concen- trated manner, from draining across the sidewalks and driveways. F. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. G. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Depart- ment. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. H. Convey;to the County of Contra Costa, by Grant Deed, the future "development rights" over the natural watercourses traversing the property. The area for i Exhibit A I ' I - 3056-85 pg. 4 which the "development rights" are to be deeded shall be determined by using the criteria outlined in Chapter 914-10, "Easements", of the Subdivision Ordinance. I. Submit a metes-and-bounds description and a plot, prepared by a licensed land surveyor or registered civil engineer, for the above-mentioned grant deed to the Public Works Department, Engineering Services Division, for review and the preparation of instruments. I Record a record of survey, prepared by a licensed land surveyor or registered civil engineer for the final development site prior to issuance of a building permit.
