APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a Memorandum of Understanding with El
Dorado County to provide administration of Federal Voting Assistance Program (FVAP) grant funds and to pay
Democracy Live, Inc., with such funds for providing the County with a military and overseas voter ballot delivery
system for the period August 14, 2012 through October 30, 2016, in an amount not to exceed $219,998.
RATIFY the Clerk-Recorder's application for membership in the Cal-E Promise Consortium of Counties and the
consortium's application for FVAP grant funds.
FISCAL IMPACT:
$219,998, 100% Federal. CFDA No. 12.217. El Dorado County, acting as fiscal agent on behalf of the County, will
pay all Democracy Live, Inc. costs, for LiveBallot services from Contra Costa County’s designated portion of
available grant funds through 2016.

Contra Costa County must pay invoices for outreach or public awareness activities and may submit a claim to El
Dorado County for reimbursement for items within the limits of the grant application.
BACKGROUND:
In 2011, the Department of Defense provided grant funds for programs to improve registration and voting processes
for military and overseas citizens. Thirteen counties; Butte, Contra Costa, El Dorado, Fresno, Lassen, Marin, Nevada,
Sacramento, San Joaquin, San Luis Obispo, San Mateo, Santa Barbara and Solano formed the Cal E-Promise
Consortium, with the goal of increasing uniformed and overseas voter participation and gathering comprehensive data
regarding voter activities. El Dorado County, designated as the lead county on behalf of the consortium, applied for
and was awarded an Electronic Absentee Systems for Elections grant from the Federal Voting Assistance Program
(FVAP) in October 2011.
Contra Costa County's share of the grant funds is $219,998.
El Dorado County selected the Contractor, Democracy Live, as the sole vendor to develop and deploy a set of
Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) voter services, including providing election and
voting information and the voter's official ballot in a secure, electronic file as soon as ballots are available. El Dorado
County will pay, from available grant funds, the County's one-time software subscription fee after the Clerk-Recorder
or designee acknowledges that the LiveBallot system has been successfully deployed by the County. The County's
annual fee to the vendor will also be paid by El Dorado from the grant funds through 2016. If grant funds become
unavailable the Contractor's services may be terminated.
Contra Costa County must pay invoices for outreach or public awareness activities and may submit a claim to El
Dorado County for reimbursement of up to $10,998, for items within the limits of the grant application. El Dorado
will submit claims on a monthly basis, as required by County activities, to request reimbursement from Federal
Voting Assistance Program (FVAP) grand funds for these items.
El Dorado County is responsible for all data gathering and reporting of statistics required by the grant.
CONSEQUENCE OF NEGATIVE ACTION:
The County will not have funds available to pay for the costs to set up and deploy a secure electronic ballot delivery
system for improved communications and services to military and overseas voters, including sending the official
ballot to eligible voters by the federally mandated 45 day deadline prior to an election. Failure to improve the
County's delivery of ballots to military and overseas ballot may result in actions by the Federal Department of Justice
to require the County to comply with the federal Military and Overseas Voter Empowerment Act (MOVE).
