THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on February 4, 1986 , by the following vote:
AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers

SUBJECT: Hearing on Rezoning Application 2646-RZ and' Development
Plan No. 3052-85 Filed by East-West Construction Company
(applicant) and Gary & Myrtle Ries (owners) , Martinez
Area
This being the time for hearing on the recommendation of
the Contra ' Costa County Planning Commission with respect to the
application filed by East-West Construction Company and Gary &
Myrtle Ries (2646-RZ) to rezone . 22 acre located at 3100 Pacheco
Boulevard (Southeast corner of Pacheco Boulevard and Santa Fe
Avenue) from Multiple Family Residential District (M-29) to
Limited Office District (0-1) together with Development Plan No.
3052-85 to ; establish general offices in an existing building; and
Harvey Bragdon, Assistant Director of Community Develop-
ment, described the property site and advised that a Negative
Declaration of Environmental Significance was posted for these
projects ; and
The Chairman opened the public hearing and no one appeared
in opposition. The public hearing was closed.
The Board considered the matter. IT IS BY THE BOARD
ORDERED that rezoning application 2646-RZ is APPROVED as
recommended by the County Planning Commission and that Develop-
ment Plan 3052-85 is also APPROVED subject to conditions imposed
by the Planning Commission and the Board of Supervisors as set
forth in Exhibit A attached hereto and by reference incorporated
herein, and the Board hereby adopts the Planning Commission' s
reasons , set forth in its Resolution Number 67-1985 as its
determinations for this decision.
IT IS FURTHER ORDERED that Ordinance Number 86-15 giving
effect to the aforesaid rezoning is INTRODUCED, reading waived
and February 25, 1986 , is set for adoption of same.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3052-85:
I. Development shall be generally as shown on the plans submitted with the application
and dated received October 24, 1985, by the Community Development Department.
2. Prior to the occupancy of the existing building, elevations and architectural design of
the exterior of the building and roofing materials shall be subject to final review and
approval by -the County Zoning Administrator. The roofs and exterior walls of the
buildings shall be free of such objects as air conditioning equipment, television
aerials, etc., or screened from view.'
3. Comply with, the landscape and irrigation requirements as follows:
A. A landscaping program shall be submitted for review and approval of the Zoning
Administrator prior to occupancy of the building. Suitable screening type of
landscaping shall be planted along the east boundary of the site. A cost estimate
shall be submitted with the landscaping program plan. The plan shall be
submitted for review and approval 15 days prior to anticipated request for
occupancy of the building.
B. California native species shall be used as much as possible. All trees shall be 15
gallon size, all shrubs shall be 5 gallon size.
C.i perimeter of the site shall be fenced with a six foot high solid wood fence.
Within 20 feet of Pacheco Boulevard and Santa Fe Avenue the fence can be
reduced',to three feet.
D.i The staff sketch in the file shall be used as a guide for on-site landscaping.
E.i Landscaping shall be installed prior to occupancy of the building. The property
owner shall maintain any landscaping within street right of way.
4. The site lighting shall be of low intensity and shall be deflected so that lights shine
onto applicant's property and not toward adjacent properties. The Zoning Adminis-
trator shall review and approve exterior lighting details prior to issuance of building
permits.
5. .Comply with, the requirements"of the Contra Costa Consolidated Fire District.
6. If archaeologic materials are uncovered during grading, trenching or other on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society of California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation measures,
if they are deemed necessary.
7. Comply with the requirements of the Mt. View Sanitary District.
8. The access drive off of Pacheco Boulevard shall be signed and striped to indicate that
it is to be used as an entrance only.

9. One of the two parking spaces along the east wall of the building shall be striped and
signed to be .a handicapped parking space.
10. The design and color of any identification signs shall be reviewed and approved by the
Zoning Administrator. Signs shall be kept low and within limits of the O-1 Zoning
District.
11. Comply with' the requirements of the County Building Inspection Department.
12. Comply with drainage, road improvement, traffic and utility requirements as follows:
A. In accordance with Section 82-2.014 of the County Ordinance Code, this
development shall conform to the requirements of Division 914 (Drainage) of the
Subdivision Ordinance, unless exceptions are specifically granted.
B. The following exception to Division 914 is permitted for this project:
1) Section 914-2.006, "Surface Water Flowing from Subdivision", provided the
applicant maintains the existing drainage pattern and does not dispose
concentrated storm waters onto adjacent properties.
C. Unless exceptions are specifically granted, comply with the requirements of
Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code.
This includes the following:
1) Construct curb, 4-foot 6-inch sidewalk (width measured from curb face),
necessary longitudinal and transverse drainage, and approximately 7 feet of
pavement widening on Santa Fe Avenue. The face of curb shall be located
18 feet from the centerline of the street.
2) Relocate the power line along the frontage on Santa Fe Avenue.
D. Construct the on-site driveway system to current County private road standards
with a minimum width of 16 feet.
E. Install all new utility distribution services underground.
F. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalks and driveways.
G. Submit improvement plans prepared by a registered civil engineer to the
Public Works Department, Engineering Services Division, for review; pay the
inspection, plan review and applicable lighting fees. These plans shall include
any necessary traffic signage and striping plans for review by the County
Traffic 'Engineer. The improvement plans shall be submitted to the Public
Works Department, Engineering Services Division, prior to the issuance of
any building permit. The review of improvement plans and payment of all
fees shall be completed prior to the clearance of any building for final
inspection by the Public Works Department. If final inspection is requested
prior to construction of improvements, the applicant shall execute a road

improvement agreement with Contra Costa County and post bonds required
by the,agreement to guarantee completion of the work.
H. Contribute $1.15 per square foot of gross floor area to a Road Improvement
Fee Trust (Fund No. 819200-0800) designated toward the construction of
improvements to Pacheco Boulevard. This contribution will be credited
against any road improvement fee adopted subsequent to the approval of this
development plan.
