BOYD , Deputy RECOMMENDATION(S): The Board of Supervisors, as the Governing Board of the Contra Costa County Flood Control and Water Conservation District (District) does hereby: APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute the Grants of Easements for the conveyance of an irrigation line easement and for ingress and egress rights over portions of Assessor Parcel Number (APN) 019-070-010, located off Fairview Court, Brentwood and identified as the District’s DA30C Line “A” Channel, South Basin (South Basin) to East Contra Costa Irrigation District (ECCID) pursuant to Government Code Section 25526.5; Project 7558 6D8312; and RECOMMENDATION(S): (CONT'D) ACCEPT the Quitclaim Deed from ECCID; DETERMINE that the conveyance of said easement rights are in the public interest and will not substantially conflict or interfere with the District’s use of the South Basin; and DIRECT the Real Estate Division of the Public Works Department to cause said Grants of Easements and Quitclaim Deed be recorded in the office of the County Recorder. FISCAL IMPACT: There is no fiscal impact. BACKGROUND: The District acquired APN 019-070-010 in 2001 for the South Basin. ECCID has undefined rights over the entire property. When the District constructed the South Basin, they removed ECCID’s existing irrigation pipeline, replaced it with a new irrigation pipeline in a new location, and placed it deeper into the ground. ECCID has agreed to quitclaim its rights over the entire South Basin to the District in exchange for the District granting them a defined easement area for their irrigation pipeline and an easement for ingress and egress to their irrigation pipeline. Staff has determined that the property interest to be conveyed to ECCID has a value of less than $25,000. This Board approved a Notice of Determination on April 5, 2005 and filed on April 11, 2005. CONSEQUENCE OF NEGATIVE ACTION: ECCID will continue to have undefined property rights over the District’s South Basin. CHILDREN'S IMPACT STATEMENT: Not Applicable.
