APPROVE and AUTHORIZE the Agricultural Commissioner, or designee, to execute Agreement #11-0559-SF with
the California Department of Food and Agriculture in an amount not to exceed $47,645 to reimburse the County for
regulatory work for the Light Brown Apple Moth, for the period January 1, 2012 through September 30, 2012, as
recommended by the Agricultural Commissioner.
FISCAL IMPACT:
This agreement reimburses the County for expenditures incurred January 1, 2012 through September 30, 2012 not to
exceed $47,645.
BACKGROUND:
The Light Brown Apple Moth (LBAM) was first detected in Contra Costa County on March 7, 2007 and
subsequently has become generally infested. As multiple detections of LBAM continued, the California Department
of Food and Agriculture proposed emergency adoption of Section 3434, Light Brown Apple Moth Interior
Quarantine, eventually adding the entirety of Contra Costa County. The United States Department of Agriculture
(USDA) issued a Federal Domestic Quarantine Order

BACKGROUND: (CONT'D)
(DA-2007-42), regulating the interstate movement of host material from the infested areas of California and Hawaii.
This regulation requires all nurseries, green waste facilities, community gardens and harvested commodities within
the infested areas be issued a quarantine compliance agreement and be inspected every 30 days. The purpose of the
quarantine compliance agreements and inspections is to assure that plant production nurseries only ship non-infested
plant material outside of the quarantine area thus reducing the artificial spread of the organism.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to accept Agreement #11-0559-SF will in failure to meet state mandates, reduced revenue to the Department
and would negatively impact the counties nursery industry as they would not be able to meet the requirements to ship
to non-infested areas outside of the county.
