HomeMy WebLinkAboutMINUTES - 06262012 - SD.9RECOMMENDATION(S): ADOPT Resolution No. 2012/268 approving the interim Memorandum of Understanding (MOU) between Contra Costa County and the California Nurses Association (CNA) implementing negotiated wage agreements and other economic terms and conditions of employment for employees in specified per-diem nursing classifications, for the period of May 15, 2012 through January 31, 2013. FISCAL IMPACT: The terms and conditions set forth in this action have an estimated cost of $485,000 in FY 2012-13 and beyond. BACKGROUND: The California Nurses Association (CNA) and the County reached a Tentative Agreement (TA), which CNA members ratified on May 23, 2012. The resulting Memorandum of Understanding, which is attached, includes modifications to wages, retirement, health care, and other benefit changes for employees in per-diem classifications. In summary, those changes are: Recognition. CNA is the formally recognized employee organization for the Staff Nurse – Per Diem (VWWA) and the Staff Advice Nurse – Per Diem (VWXF) classifications effective on May 15, 2012, pursuant to Ch. 34-12 of Resolution 81/1165. Notwithstanding the provisions of Government Code section 3504, the scope of representation by CNA excludes collective bargaining for retired annuitants employed by the County in the above per diem classifications on the subjects of health benefits, dental benefits, and retirement benefits. Maintenance of Benefits. During the term of this Interim MOU, the County agrees to maintain the benefits provided for employees in the Staff Nurse – Per Diem and the Staff Advice Nurse Per Diem classifications in Resolution No. 2012/121 (Compensation and Benefits for Unrepresented Employees) as set forth in the attached Side Letter. General Wage Increase. Effective on July 1, 2012, the pay reduction effective October 1, 2011, will be restored for the classifications of Staff Nurse – Per Diem (VWWA) and the Staff Advice Nurse – Per Diem (VWXF). No Strike. During the term of the Interim MOU, CNA, its members and representatives, agree that it and they will not engage in, authorize, sanction, or support any strike, slowdown, stoppage or work, sickout, or refusal to perform customary duties. The parties will continue to meet and confer during the term of this Interim MOU in order to reach a comprehensive MOU regarding the classifications of Staff Nurse-Per Diem and Staff Advice Nurse-Per Diem prior to the expiration of this Interim MOU. CONSEQUENCE OF NEGATIVE ACTION: The County will not have a memorandum of understanding with the employees in the per-diem classifications for this Unit. CHILDREN'S IMPACT STATEMENT: None.
