HomeMy WebLinkAboutMINUTES - 06262012 - C.154RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee, to execute an agreement between the City of Concord and a group of homeless service providers, including the County, in connection with land transfers and the development and operation of housing units for homeless persons on portions of the former Concord Naval Weapons Station. FISCAL IMPACT: No fiscal impact to the County. No additional county funds are required. BACKGROUND: Congress declared the Concord Naval Weapons Station (CNWS) as surplus federal property in March 2005. In December 2005, the City of Concord was named as the local redevelopment agency (LRA) for CNWS. Under the pertinent federal laws, the LRA is required to incorporate a homeless assistance plan into the CNWS reuse plan. Working together, the members of the Collaborative prepared and presented to the LRA a comprehensive proposal for providing homeless services at the CNWS site. The proposal includes the development of housing to be used by otherwise homeless persons. The proposal was accepted by the LRA. To enable the members of the Collaborative to carry out their proposed plan, and to satisfy relevant federal laws, the LRA and the members of Collaborative are entering into an agreement (Agreement). A copy of the Agreement is attached. Under the Agreement, the LRA is required to designate at least four parcels, consisting of a total of approximately 16 acres, for the development of housing units to be made available for use by homeless persons. After the LRA identifies the location of a “Homeless Site,” and certain conditions have been met, ownership of the Homeless Site will be transferred from the LRA to a homeless developer chosen by the Collaborative. Each Homeless Site will be (i) environmentally remediated prior to its transfer to the homeless developer, and (ii) subject to recorded covenants that require homeless units to be constructed within a certain period of time and the use of those units by persons who meet the definition of “homeless persons.” The use restrictions on each Homeless Site will have a term of at least 55 years. If the homeless developer to which the property is transferred fails to adhere to the use restrictions, the LRA can declare a default. If the default is not cured within a specified time period by the homeless developer that owns the property, the Collaborative, or the County, in its capacity as the Continuum of Care Coordinator for Contra Costa County, ownership of the property may revert to the City of Concord. If the property reverts to the City of Concord, the city is not obligated to continue to use the property to provide homeless services. The members of the Collaborative desire that the Collaborative become an unincorporated association under California law and a signatory to the Agreement. In this way, the members of the Collaborative will be better able to work together to carry out the Collaborative’s rights and obligations under the Agreement. A separate board order will request authority for the County to participate as a member of the Collaborative when the Collaborative becomes an unincorporated associatiion. CONSEQUENCE OF NEGATIVE ACTION: The County will not enter into the Agreement, which may cause a delay in, or cancellation of, the transfer of the former site of the Concord Naval Weapons Station from the Navy to the City of Concord. As the Continuum of Care Coordinator for Contra Costa County, the County’s participation in the project is considered vital by both the Navy and the U.S. Department of Housing and Urban Development (HUD).
