HomeMy WebLinkAboutMINUTES - 06262012 - C.112RECOMMENDATION(S): APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a contract amendment with Election Systems & Software, LLC (ES&S) in an amount not to exceed $525,525 to a new payment limit of $1,050,260 to continue providing hardware and software maintenance services and support, and extend the term from January 1, 2013 through December 31, 2014. FISCAL IMPACT: The two year contract extension cost is included in the department’s 2011-12 budget, 100% General fund. Extending the contract and making the payment from the current budget will allow the department to take advantage of a $22,661 discount. This amount does not include funding for an optional two-year renewal for 2015-2016. BACKGROUND: Due to the Federal Help America Vote Act (HAVA) of 2002, Contra Costa is required to have a voting system in place that allows voters with physical and/or visual disabilities to vote confidentially and unassisted. The contract included licensing, maintenance and support for 5 years. A new contract for licensing, maintenance and support was executed in 2010 for 2011-2012, the contract included provisions for two optional two year renewal periods. This request is the first of those two options. Licensing, maintenance and support is required for the system. CONSEQUENCE OF NEGATIVE ACTION: Licensing is required to use the vote tally system. Without it, Contra Costa would not be able to count ballots. Without maintenance and support, the voting system will not be maintained, as required, and Contra Costa may not meet Federal mandates for accessibility and language. Contracting with outside maintenance contractors would void warranties, which could require expensive equipment replacement. CHILDREN'S IMPACT STATEMENT: Not Applicable.
