HomeMy WebLinkAboutMINUTES - 06262012 - C.89RECOMMENDATION(S): APPROVE and AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District, or designee, on behalf of the Contra Costa Clean Water Program, to execute a Contract Amendment with Dan Cloak Environmental Consulting, to increase the payment limit by $120,000, for a new total contract amount not to exceed $245,000, and to extend the contract period to June 30, 2013, for continuing compliance assistance with mandated federal and state stormwater rules contained in National Pollutant Discharge Eliminiation System (NPDES) Permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards. Countywide. (100% Cities and County Stormwater Utility Fee Assessments) Project No. 7519-6X7645 FISCAL IMPACT: The increased cost shall be funded by stormwater utility fee assessments collected by the Cities/Towns and County, proportional to their respective populations. Bueren, Public Works Director/Chief Engineer Date:June 26, 2012 Contra Costa County Subject:Execute a Contract Amendment with Dan Cloak Environmental Consulting BACKGROUND: (CONT'D) District (District), hereinafter referred to as "Co-permittees". The CCCWP was established in 1991 through a "Program Agreement" in response to the 1987 amendments to the federal Clean Water Act (CWA), which established a framework for regulating municipal stormwater discharges under the National Pollutant Discharge Elimination System (NPDES) Permit Program. The United State Environment Protection Agency (USEPA) published final stormwater rules implementing the 1987 CWA amendments in November 1990. The rules mandate Co-permittees to reduce or prohibit the discharge of pollutants into, and from, the municipal storm drain system. Co-permittees conduct many of these mandated stormwater pollution prevention and control activities collectively (also referred to as "Group Activities"). The roles and responsibilities of the Program and Co-permittees are outlined in the Program Agreement, which was last updated and adopted by all Co-permittees in June 2010. The Program is made up of representatives of each of the 19 cities/towns, the County, and the Flood Control District. Each city/town/County/District manager designates one representative to participate on the Management Committee, which is the CCCWP's decision-making body. Dan Cloak Environmental Consulting is recognized regionwide as a leader in the field of Low Impact Development (LID). The Management Committee has directed that important requirements of the Joint Municipal NPDES Permits, such as LID, be performed by the CCCWP. Dan Cloak Environmental Consulting has performed well in providing technical and project management services to the Program during Fiscal Year 2011/12, and has contributed to keeping the Program in compliance with permit requirements. In order to help the Program continue to maintain compliance, Program staff, on behalf of the cities/towns, the County, and the District, respectfully requests approval of this contract extension. CONSEQUENCE OF NEGATIVE ACTION: If the Contract Extension with Dan Cloak Environmental Consulting is not approved, the CCCWP would not be able to fulfill the permit mandates, and municipalities could be found in non-compliance with the NPDES permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards. Fines totaling $10,000 per day and $10 per gallon of stormwater discharge could potentially be imposed. CHILDREN'S IMPACT STATEMENT: Not Applicable. ATTACHMENTS D. Cloak Agmt Ext FY 2013
