APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract
amendment with the City of Richmond, to increase the payment limit by $596,463 from $1,560,860 to $2,157,323,
and extend the term from June 30, 2012 to September 30, 2013, in order to pay the City for continued assistance
staffing the North Richmond Mitigation Fee Committee and jointly administering the implementation of City/County
approved Expenditure Plans.
FISCAL IMPACT:
No impact to the General Fund. Cost of the proposed Amendment would be covered by North Richmond Mitigation
Fee Funding jointly administered by the City of Richmond and Contra Costa County.
BACKGROUND:
The North Richmond Waste and Recovery Mitigation Fee was established by the City of Richmond and Contra
Costa County in 2004 and is subject to the joint-control of the City and County. This Mitigation Fee was originally
specified as a Mitigation Measure in an Environmental

Subject:Amend Interagency Agreement between the City of Richmond & Contra Costa County for the Joint Administration
of North Richmond Mitigation Fee Funding
BACKGROUND: (CONT'D)
Impact Report approved by the City and County as a means of addressing impacts associated with illegal dumping
which is to be used for the benefit of the North Richmond community. The requirement to collect this Mitigation Fee
is included as Conditions of Approval in the Use Permits issued by the City and County, which allowed Republic
Services to expand their waste processing operations at the Bulk Material Processing Center located at the closed
West Contra Costa Sanitary Landfill site in North Richmond. Republic Services began collecting and paying to the
County the established per ton Mitigation Fee in 2006.
The City and County entered into a Memorandum of Understanding (MOU) in 2004 agreeing to establish a
City/County Committee (known as the North Richmond Waste & Recovery Mitigation Fee Joint Expenditure
Planning Committee) to prepare recommended spending plans subject to final City/County approvals, as the means of
jointly administering this funding. These recommended spending plans are known as "Expenditure Plans" which must
be approved by both the City Council and Board of Supervisors. The most recently approved Expenditure Plan only
allocated funding for an initial six month period ending June 30, 2012. On June 1, 2012, the Committee
recommended approval of an Amended 2012/2013 Expenditure Plan which is expected to be considered by the
Richmond City Council and County Board of Supervisors at their meetings on June 26, 2012.
The Interagency Agreement between the City and County initially went into effect on January 16, 2007 and has since
been amended three times. This fourth Amendment is proposed to increase the contract limit by $596,463.54 and
extend the term for 15 months. This amount is adequate to allow the City to receive payment to cover costs which are
intended to be funded with allocations previously approved by the City/County for the period through June 30, 2012.
CONSEQUENCE OF NEGATIVE ACTION:
The County would not be able to reimburse the City for their share of costs to be incurred for ongoing assistance with
jointly administering this North Richmond Mitigation Fee funding.
