Project No.: WL83PV-FS1100118 DIRECT the Real Estate Division to record a certified copy of the Resolution in the office of the County Recorder. AUTHORIZE the Chair of the Board to execute a Quitclaim Deed on behalf of the District and DIRECT the Real Estate Division of the Public Works Department to cause said Quitclaim Deed to be delivered to the grantee for recording in the office of the County Recorder. Bueren, Public Works Director/Chief Engineer Date:June 26, 2012 Contra Costa County Subject:ADOPT Resolution No. 2012/272 to vacate and quitclaim a portion of a Flood Control Easement, Danville area. BACKGROUND: In 1959, the District accepted an Easement for Flood Control purposes encumbering Assessor’s Parcel Numbers (APNs) 216-120-012 and 216-120-015 along the bank of the San Ramon Creek. A portion of the Easement is no longer necessary for the purposes for which it was granted. The current owners of APNs 216-120-012 and 216-120-015 have requested that the District issue a Quitclaim Deed for the portion of the Easement no longer necessary, in order to clear title on their property. This activity has been found to conform to the General Plan of the Town of Danville. It has been determined that a portion of the Easement is no longer necessary for the purposes for which it was granted. CONSEQUENCE OF NEGATIVE ACTION: The District may be responsible for the maintenance of an area that is no longer required for the purposes for which it was intended.
