Subject:ADOPT Resolution No. 2012/272 to vacate and quitclaim a portion of a Flood Control Easement, Danville area.
BACKGROUND:
In 1959, the District accepted an Easement for Flood Control purposes encumbering Assessor’s Parcel Numbers
(APNs) 216-120-012 and 216-120-015 along the bank of the San Ramon Creek.
A portion of the Easement is no longer necessary for the purposes for which it was granted. The current owners
of APNs 216-120-012 and 216-120-015 have requested that the District issue a Quitclaim Deed for the portion of
the Easement no longer necessary, in order to clear title on their property.
This activity has been found to conform to the General Plan of the Town of Danville.
It has been determined that a portion of the Easement is no longer necessary for the purposes for which it was
granted.
CONSEQUENCE OF NEGATIVE ACTION:
The District may be responsible for the maintenance of an area that is no longer required for the purposes for
which it was intended.
CHILDREN'S IMPACT STATEMENT:
Not Applicable.
