APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Nichols
Consulting Engineers, Chtd., (Nichols) to extend the term from April 1, 2012 to November 30, 2012 and increase the
payment limit by $25,000 to a new amount of $124,502 to incorporate revisions to the Operations and Maintenance
Plan for the Clyde Pedestrian Path. Project No.:4660-6X4114
FISCAL IMPACT:
Project is funded by 100% Navy Transportation Mitigation funds.
BACKGROUND:
In 2010, the County began the process of designing and constructing the Clyde Pedestrian Path, which will be a
bicycle-pedestrian path for the community of Clyde when completed. A Phase I and Phase II Environmental Site
Assessment was prepared to identify any hazardous materials. Nichols was hired to assist the County with design
support, bidding support during pre-construction,

BACKGROUND: (CONT'D)
construction and post construction support, and preparation of an Operations and Maintenance plan for the Path
post-construction.
Currently, outside agencies are reviewing the draft Operations and Maintenance Plan. County anticipates minor
comments from the reviewing agencies, but given the lengthy review process it is necessary to increase the
contract term and payment limit so that Nichols can incorporate the revisions to the Operations and Maintenance
Plan based on the reviewing agencies comments.
CONSEQUENCE OF NEGATIVE ACTION:
If the contract is not extended, the consultant will not be able to incorporate review comments and finalize reports.
Also, the County will not be able to meet requirements to close out the project and gain final approval from
approving agencies.
