DIRECT the Clerk of the Board to publish the attached Notice in the Contra Costa Times pursuant to Government Code Section 6061. FISCAL IMPACT: No Fiscal Impact. BACKGROUND: Under the terms of a proposed Settlement and Property Transfer Agreement and Release of Claims (“Settlement Agreement”) between the County and the Ambrose Recreation and Park District ("Ambrose"), the County would transfer its rights, title and interest in five Bay Point area parks – Lynbrook Park, Hickory Meadows Park, Viewpointe Park, Boeger Park and Tradewinds Park – to Ambrose. The Notice that the Board is being asked to approve is required prior to such transfer, pursuant to Government Code section 25365, subdivision (c). The proposed Settlement Agreement and a related Joint Exercise of Powers Agreement (“JEPA”), the latter pertaining to the transfer of assessment revenues for maintenance of improvements in the five parks, were negotiated between County and Ambrose staff in response to litigation filed by Ambrose against the County in December 2009, (Ambrose Recreation and Park District v. County of Contra Costa et al., Contra Costa County Superior Court Case No. C09-03545). Ambrose has approved and executed both the Settlement Agreement and the JEPA. Both documents are scheduled to be presented to the Board for consideration on June 26, 2012. Additional background and details will be provided when the proposed settlement is presented to the Board. CONSEQUENCE OF NEGATIVE ACTION: In the absence of a properly published Notice of Intention, the Board would lack authority to approve the proposed Settlement Agreement.
